I read his brief. This seems to be crux of his argument attributing outputs as developer speech. What he’s describing here is developers shaping *possibility space*.

expressiveness of LLM output. But LLMs are coded, trained, reinforced, and fine-
tuned via indisputably expressive decisions by their developers to produce desired
outputs. The LLM is a product and transmitter of its developer's expression. The
Order also overlooks the expressive inputs of users in guiding the LLM, through repeated interaction, to produce the type of content they wish to receive-imbuing the Al output with their own expression, as well. The result is collaborative, but unquestionably expressive. One might debate which set of expressive inputs controls the analysis. But whatever the answer, "stringing words together" is surely speech.
And the First Amendment does not just protect "words;" it protects the speech process,
which includes "creating, distributing, or consuming speech." Brown v. Entm't Merchs.
Ass'n, 564 U.S. 786, 792 n.1 (2011).

Israeli soldiers opened fire Tuesday morning near crowds of Palestinians walking toward a new food distribution site in southern Gaza, the Israeli military said. The Red Cross and Gaza health ministry said at least 27 people had been killed.

It was the second such shooting by Israeli forces in three days near the same aid distribution site in the southern city of Rafah, where thousands of desperate and hungry Palestinians are coming early each day in hopes of securing a food handout. Israeli soldiers opened fire on Sunday near an approach to the same food distribution site, and Palestinian officials said they killed at least 23 people.

You see, I know its complicated for you, but he needed to do those things before the suspect was able to have the case dismissed. Not that complex of an idea. And maybe this could've been avoided if he had done his job:
