So let’s look at how the processing is described in the @dpcireland.bluesky.social decision of 9th June 2025. Oh look. “Biometric template” used for “one to many” and “one to one” matching. If it walks like a duck and quacks like a duck we might just have a bird of the genus Anatidae on our hands.

Where a data subject already holds a PSC and seeks to renew it, they can update the photograph of their facial image online (up until March 2020, they could also do so by post). 6 This is in turn subject to a similar process, whereby the template is subjected to one-to-many matching and in addition is compared against the previous template held in relation to the same data subject. That is, the new template is matched against the previous template. This is referred to as "one-to-one matching".

Also: selection of NACE code is mandatory for a business, but there are only 17 entries and one of those is “Private Household with Employed Persons”. Nothing like “Business or other Management Consulting Services (NACE70.22). So, that data will be useless for any form of reporting.

Doing a tidy in my office at home (instead of doing the research that was scheduled today). Found this from almost 16 years ago. I did two talks at this conference. One on #DataQuality and #DataProtection and another on #DataQuality and #Strategy. Content still 100% relevant today!

Bluntly: this is illegal. It violates a very fundamental principle in #GDPR and in #DataGovernance - separation of duties / independence of DPO. There’s case law and extensive guidance on this principle under GDPR

Extract from EDPB guidance on role of DPO. Text reads:
“The absence of conflict of interests is closely linked to the requirement to act in an independent
manner. Although DPOs are allowed to have other functions, they can only be entrusted with other
tasks and duties provided that these do not give rise to conflicts of interests. This entails in particular
that the DPO cannot hold a position within the organisation that leads him or her to determine the
purposes and the means of the processing of personal data. Due to the specific organisational structure
in each organisation, this has to be considered case by case.
As a rule of thumb, conflicting positions within the organisation may include senior management
positions (such as chief executive, chief operating, chief financial, chief medical officer, head of
marketing department, head of Human Resources or head of IT departments) but also other roles lower
down in the organisational structure if such positions or roles lead to the determination of purposes
and means of processing. In addition, a conflict of interests may also arise for example if an external
DPO is asked to represent the controller or processor before the Courts in cases involving data
protection issues.”

So, this is how the holder of the post of Information Commissioner in the U.K. response to a valid comment by a highly respected #DataProtection expert when invited to comment on “what does privacy mean to you”. Not exactly the kind of response you’d expect.

I occasionally look at the cookie banner behaviour of sites that people *have* to use. This is the site of Ireland’s National Car Testing Service. It pre-ticks boxes for consent (illegally) and then you can’t actually set those choices and have to click accept to move on (invalid consent). #GDPR
