HHS is reporting that it is NOT withdrawing the anti-trans medicaid/medicare rule. However, there are signs that it has deprioritized the rule, and it may never be finalized. Hospitals MUST return to providing care, this rule is not hanging is not in effect and may be indefinitely delayed.

8. The Court gave a wide lane for lawsuits in blue states that allow trans athletes to participate. Though the majority avoided ruling on whether inclusive states are violating Title IX, it endorsed the theory that even a single transgender athlete on a girls' team "displaces" cisgender athletes.

And as to competitive fairness, allowing biological malesto play on women’s and girls’ sports teams can put femaleathletes at a serious disadvantage. That is because sportsare generally zero sum. Allowing a biological male athlete to compete on a girls’ team necessarily displaces ordisadvantages a female athlete—replacing her on the roster, knocking her out of the starting lineup, reducing herplaying time, depriving her of a medal, and the like. That hard reality of sports cannot be ignored or swept under the rug. On the contrary, that reality must and does inform interpretation of the term “reasonable” in the Javits Amendment.

4. Plank 203(c) goes further than any state party platform in the country, calling for an outright ban on businesses expressing support for transgender people:

3. The platform also calls for the criminal prosecution of parents of transgender youth under child abuse statutes—something Governor Abbott has already attempted, directing the Department of Family and Protective Services to investigate families of trans children in 2022. Plank 150 states:

"Any agency, individual, or other entity promoting, performing, or facilitating gender-transitioning or gender-modification of a minor child shall be criminally prosecuted for child abuse and exposed to civil actions, enjoying no immunity regardless of profession, relation, or standing." Importantly, the platform does not stop at minors. Plank 149 extends its prohibitions to legal adults as old as 25, banning all gender-affirming "medical or mental health intervention for persons between the ages of 18 and 26," including not just surgery, puberty blockers, and hormones, but even "assigning name and/or pronoun changes.”

2. Plank 116 of the platform goes on to call for banning trans teachers, social trasnition, any curriculum, library materials, or extracurricular offering that "adopts, supports, or promotes gender fluidity or transgender ideology" and prohibiting school staff from "engaging in transgenderism"

"Gender Identity Ideology in Schools: The official position of the Texas schools shall be that there are only two genders: biological male and biological female, which are immutable and cannot be changed. We support the total prohibition of so-called social transitioning. We oppose transgender normalizing curriculum, library materials, and pronoun use. We support the prohibition of transgender individuals from serving in any school district positions, including in volunteer roles, and mandate the exclusive use of pronouns corresponding to a person's biological sex at birth.”

8. When asked by The Advocate about the limited relief, Kell Olson from Lambda Legal acknowledged the limitations. See the update from Christopher Wiggins at The Advocate:

“Olson told The Advocate that the narrower relief reflects the preliminary stage of the litigation rather than the full scope of the challenge. “The lawsuit asks for the law to be blocked as to all restrooms, period,” Olson said. “The preliminary relief is slightly narrower.” He said attorneys sought immediate protection in situations where transgender people otherwise would have no practical alternative. “If you do not have a gender neutral option that is available nearby, then you can access the restroom consistent with your gender identity,” Olson said. “That was our main concern: to make sure that people had a ready and safe option anywhere they found themselves.”

Olson acknowledged that some enforcement scenarios remain possible while the case proceeds. “Technically, there will still be the ability for enforcement,” he said, pointing to locker rooms and situations where a gender-neutral option is immediately available. But he said the ruling removes enforcement in a substantial number of circumstances and ensures transgender people have a restroom option throughout the state.”

4. The confirmation comes after a city council budget hearing. Councilmember Tiffany Cabán asked Commissioner Alister Martin—the city’s top public health official, appointed by Mamdani in January—whether the clinic would serve youth. He said no, citing fear of federal clawbacks.

3. So when Health Commissioner Dr. Alister Martin announced Friday that the city would open its first-ever direct-care clinic for transgender people, it seemed like the administration was finally delivering. Then, we got this statement from the NYC Health Department:

"Transgender, gender-nonconfirming, and nonbinary New Yorkers deserve age-appropriate health care that is affirming, respectful, and considerate of all their needs. That’s why, for the first time later this summer, the NYC Health Department will be expanding services to provide gender affirming hormone therapy to adults 19 years of age and older at our Corona Sexual Health Clinic. As with the other clinic services, gender-affirming hormone therapy will be offered at no to low cost and regardless of immigration status. We look forward sharing more details upon launching the pilot,” said a NYC health Spokesperson in a statement to Erin In The Morning.

Here's the full quote/exchange from the city council hearing by the way where Commissioner Martin directly says its because they are worried about federal clawbacks.

Commissioner Alister Martin: "It's incredibly important that we get the messaging right here and that we lean in on the comms and the campaign here, but it's also important to deliver for people and to provide the services they need. And we're excited to say that pretty soon we're going to be able to offer gender-affirming care directly at our clinics. We have a clinic that will be opening up in Corona which will offer gender-affirming hormone therapy for adults. It's like one of the first times a public health department has ever taken that step, and we're proud to not just stop there. We'll continue moving forward with this."

Councilmember Tiffany Cabán: "Can I ask a follow-up on that? Particularly because that's a really big deal, but also—we're seeing this devastating decrease in services for youth, and especially youth under 13, 12—like, there are almost no providers who provide that care. And the one or two that do is obviously under attack from the federal government. So is there going to—are you thinking about an expansion in that youth care? Because I'm talking to parents all the time and they don't know where to take their children."

Commissioner Martin: "As you can appreciate, the balance that we have to strike is—we are committed to this issue and want to make sure that we provide the services and resources for youth, as well as making sure that we don't expose ourselves to clawbacks from the federal government, which disrupt the rest of the care that we can give. And so there's much more to come on this, trying to sort of figure out that right balance. We're eager to work with you on this, but rest assured we are working on this and we're trying to figure out how to do this."

This is obscene. Mamdani literally ran on opposing this kind of capitulation. He went to the protest at NYU, who made the EXACT same decision for the EXACT same reason. It's notable there is NO federal law that pulls funding right now. The Kennedy Declaration is blocked in ocurt.

City-run clinics, including a new health center opening in Corona, Queens, will soon offer hormone therapy to trans and nonbinary adults, but not to adolescents, according to city health officials.

NYC Health Commissioner Dr. Alister Martin told members of the City Council at a health budget hearing that the administration is weighing how to expand access to such services for minors, but must strike a balance between providing care to trans youth and avoiding federal backlash.

“We are committed to this issue and want to make sure that we provide the services and resources for youth as well as making sure that we don't expose ourselves to clawbacks from the federal government, which disrupt the rest of the care that we can give,” Martin said.

Rep. Moulton has issued a response:

“Seth was honored to walk in solidarity with and support the LGBTQIA+ community on Saturday. Let’s be clear: what you see in that clip was a coordinated political stunt, led by a staffer from Senator Markey’s 2020 campaign and other Markey supporters. They passed out anti-Moulton flyers and actively asked bystanders to boo.

Seth has a 100% voting record from the Human Rights Campaign for supporting LGBTQIA+ issues in Congress. Senator Markey started his career as pro-life and pro-death penalty, voted for the 1994 Crime Bill and the Iraq War, and has taken tens of thousands of dollars from the fossil fuel lobby during this campaign — but we wouldn’t say he’s not progressive. The type of purity politics being played by Markey supporters only benefit Trump and MAGA Republicans, and harms the communities both Senator Markey and Congressman Moulton support.”
