Weeks ago, I warned that vacating the District Court’s
injunction in these cases would “unleash chaos and . . . con-
fuse voters.” Caster, 608 U. S., at ___ (dissenting opinion)
(slip op., at 4). Nevertheless, the Court forged ahead. Now
the Court is squarely faced with a record of the turmoil it
has caused and the harm it has wrought. Yet just as Ala-
bama doubled down on racial discrimination, the Court to-
day doubles down on chaos. Because I choose to defend the
rule of law and the right of all Alabamians to participate
equally in democracy, I respectfully dissent.

The pettiness and venality of these people is so infuriating.

The ‘All Stations’ program was established in 2021 as part of the Infrastructure Investment and Jobs Act and is designed to help fund station retrofits in order to bring them into compliance with the Americans with Disabilities Act of 1990. The federal law requires public transportation to be fully accessible to people with disabilities.

Senators Kristen Gillibrand and Schumer, along with Bronx representatives Alexandria Ocasio-Cortez, Torres and Espaillat, charged in a May 1 letter to Sean Duffy, the federal transportation secretary, that the MTA was the only recipient of 2024 ASAP funds that were still under review — and therefore held up — “with no indication as to why.”

“Ours was held in the secretary’s office, that’s what we were told, it was not moving,” Lieber said. “Every other grant in that category, the ASAP program, was moved along to the next phase and delivered on — that grant alone was being held.”

A spokesperson for the U.S. Department of Transportation did not respond to requests for comment.

Plenty of good seats are still available: visible lack of participation colors this spring’s ferocious stock market rally, at least according to one key market cog. Thus, average daily volumes in the State Street SPDR S&P 500 ETF Trust have registered at 64.8 million shares since March 30, well below the 76.4 million seen over the past 52 weeks. Monday’s turnover registered at a paltry 33.1 million shares, not far above the five-year nadir of 26 million traded on February 10, 2025.

An eyebrow raising burst of activity marks a noteworthy contrast with the broader malaise. On Friday, shares in real estate brokerage Re/Max Holdings jumped more than 20% to $7.99 on 1.4 million shares in trading volume, a sum which compares to the stock’s one-year average turnover of fewer than 300,000 shares (hat tip to Peter Berezin, chief global strategist at BCA Research).

Following that prescient price action, Monday brought news that Re/Max will be acquired by peer Real Brokerage in a deal valuing the target at $13.80 per share. The stock settled today at $11 and change.
