Open cases show up in border officers' system. They may also ask questions about suspected criminal activity. Green card holders with open criminal cases should consider consulting an immigration attorney before travelling internationally to understand the new risk.
NOW: Green card holders with *any* past criminal convictions may face risk of detention, deportation, and loss of their green card when returning to the US from international travel. Green card holders with open criminal cases may also face a risk when returning from international travel
What does it matter? Generally green card holders are free to travel internationally, and they have protections when they return to the US - but there are exceptions. Certain convictions put green card holders at risk of detention + deportation if they leave the US and return
First: what did the court decide? The court decided that in *some* situations border officers can treat green card holders returning from travel as if they are seeking (new) admission -- all based on an open criminal case (regardless of conviction)

Hundreds of New Yorkers came together this past weekend to remind legislators and @governor.ny.gov that any immigration package passed without the New York for All Act is NOT ENOUGH. We need #NY4All now!
New Yorkers made it clear across the state this weekend that New York must end law enforcement collusion with ICE and CBP -- and until the legislature passes #NY4All and @governor.ny.gov signs it into law, they can't claim they're meeting this moment of mass deportations and ICE violence.

Last wk @governor.ny.gov announced a budget immigration package that includes what she calls "protections against ICE" but the truth is it doesn't prohibit the use of state + local resources - including law enforcement, from being used to collude w/ ICE. We need comprehensive solutions like #NY4All
Across the US and here in New York, ICE relies on discriminatory + aggressive policing to racially profile + target immigrants. Despite this @governor.ny.gov's immigration package would continue to give law enforcement free rein to feed the arrest-to-deportation pipeline. What we need is #NY4All!
