This is a screenshot I took from one of the videos showing the moment the *first* shot is fired. You can see from the placement of the shooters legs that he is already on the side of the vehicle. No danger to him whatsoever.
DOJ policy only allows firing at a driver who actually is trying to kill an officer (not the case here) if there is no other objectively reasonable method of defense. The officer literally just stepped out of the way and kept firing while out of the way.
