Short and interesting CA9 order here on General Order 3.6(d), which concerns appeals from a case after it's been remanded to the district court. The previously assigned panel is supposed to be notified and is encouraged to take the new appeal, but the clerk's office missed this one.
Former Alito clerk Matthew Schwartz, whom the Senate will confirm to the Second Circuit next month, said in written responses that Alito is his ethical role model and that he considers Alito foundational to his judicial philosophy because he "carefully studies the facts and law of each case."

Sparse attendance at tomorrow's Judiciary Committee hearing. This could have accommodated one more circuit judge nominee and two or three more district judge nominees (and the Red State vacancies are there), but thankfully the WH doesn't seem to have its act together.
