The Landmark Case: FTC v. Affordable Media (The Anderson Case, 9th Cir. 1999)
This is the foundational case every lawyer in this space knows. The Andersons created a Cook Islands trust while under investigation by the FTC for fraudulent investment schemes, transferred assets offshore, and claimed they could no longer access the funds. Jamesburnslaw
The mechanics played out exactly as designed. When the FTC obtained a repatriation order, the offshore trustee AsiaCiti notified the Andersons that the restraining order was an "event of duress" under the trust, removed the Andersons as co-trustees because of the duress, and refused to provide an accounting or repatriation of the assets. The Andersons even tried appointing their children as trustees to show good faith — but AsiaCiti removed them from acting as trustees because the event of duress was continuing. JustiaJustia
The Ninth Circuit upheld the contempt finding anyway, on the theory of self-created impossibility: "It is readily apparent that the Andersons' inability to comply with the district court's repatriation order is the intended result of their own conduct — their inability to comply and the foreign trustee's refusal to comply appears to be the precise goal of the Andersons' trust." Critically though — and this is the part that tends to get glossed over — the Cook Islands trust itself was never broken. The FTC never recovered the trust assets through Cook Islands proceedings. The Andersons suffered personal consequences in the U.S., but the offshore structure held. They eventually did repatriate the funds to get out of jail, but that was a personal capitulation, not a legal defeat of the trust structure itself. Blake Harris Law

1. Indefinite civil contempt (the Fanady approach)
The bluntest instrument. Jail the person until they comply or die. It works when the debtor blinks and repatriates the money; it fails when they don't. In In re Lawrence, 279 F.3d 1294 (11th Cir. 2002), the debtor was jailed for over six years for refusing to repatriate assets — this is the Stephen Lawrence case mentioned in the Forbes article, and it's the closest parallel to Fanady's situation. Eventually courts do have to confront whether the contempt has "lost its coercive effect" — one court noted that after 14 years, a contempt order "has lost its present coercive effect and that it is unlikely that the continued incarceration of the petitioner will result in compliance." This is the really interesting part, and the court records flesh it out much more than the article does.
What Fanady claimed: Fanady claimed that he had an offshore trust located in Belize which contained "everything he has ever owned," but stated that he had no way to access the assets of the trust, although it did pay his living expenses and legal fees. The "duress" clause gambit: Fanady sent a copy of the court's order to the Belize trust, and the Belize trustee — as is exactly the plan with offshore trusts faced with litigation — stated that because Fanady was under "duress," the trustee could not comply with any orders of Fanady, much less turn over any assets to the court or Harnack. This is a well-known offshore asset protection maneuver. The trust is designed from the start with a "duress clause" — the moment the settlor (the person who created the trust) is under legal compulsion, the trustee is automatically forbidden from complying. It's essentially a legal firewall built to defeat exactly this kind of court order. The trustee also attached what purported to be an order from the Supreme Court of Belize ordering that the trustee "shall not be obliged to act in response to, in furtherance of, or in compliance with any order or process of a foreign court." A Much Worse Pattern in the Court Record
The Sun-Times article presents Fanady somewhat sympathetically. The appellate court records tell a considerably darker story:
The record showed Fanady's "attempts to evade the jurisdiction of the court and to defraud this court" as well as a Florida court, where he obtained a dissolution of marriage judgment under false pretenses. The record further showed that Fanady "forged a dissolution judgment in order to obtain a religious divorce" and attempted to "hide marital assets by selling one presumptively marital CBOE seat and hiding the money received in Switzerland and by transferring 120,000 presumptively marital shares" from partnership accounts. He also simply stopped participating in the divorce proceedings. Initially, he participated in the process, but by March 2010, he ceased to appear for hearings or respond to Wife's counsel or court notices. The courts have repeatedly said he is "the architect of his own predicament." QuickRead

Fanady’s legal troubles and long jail stay stem from his divorce from Pamela Harnack. She filed for divorce in 2008. The couple had no children.

At the time, Fanady was a wealthy Chicago Board of Options Exchange trader whose fortune was tied to farm commodities and financial markets.

In 2011, a judge pegged his net worth at roughly $7.3 million and awarded Harnack 120,000 shares of CBOE stock along with the couple’s Northfield home, which she recently sold for about $1.5 million.

Years passed. The shares were never transferred.

As the stock soared in value, so did the amount Fanady was ordered to pay.

Fanady has testified that many of his expenses were paid by his Belize-based trust, but he says he had no control over its assets. He argued that the disputed shares had long since been sold and that any proceeds had been spent on living expenses, legal fees and other costs.

A judge didn’t buy that, ruling in 2020 that Fanady still owed the shares or their value — which was then estimated at more than $10 million.

Fanady maintained he had neither.

His ex-wife’s lawyers argued that he was deliberately defying the judge’s orders.

The judge agreed.

So Fanady went to jail.

He challenged his indefinite detention. But the Illinois Appeals Court upheld it, saying that his continued jailing is “coercive,” which is allowed under the law, rather than “punitive,” which is not.

Before the company started using A.I., customer service agents received thousands of questions from callers and engaged in a grand hunt through millions of pages of information to track down the answer, Mr. Rambach said. “Guess what?” he said. “Our customers were not super happy with the quality of the answer and not super happy with the speed of the answer.”

Now A.I. does the hunting and details how the information was selected and the source. The agent then reviews and if necessary, modifies and refines the answer with the caller.

In the last three months of 2025, call centers fielded 150,000 questions. Three-quarters of the time, A.I. was able to provide the right answer to straightforward questions, such as, “Why isn’t a newly connected energy monitor showing consumption levels?” In these cases, the agents used the A.I. generated response. The rest of the time, agents worked with callers on more complex problems, including helping building managers with identifying the root cause of energy alerts.

Response times were quicker and employees have been much happier, Mr. Rambach said, because the time they saved on searching databases to answer common questions left them more time to work with customers.

“Now the system tells us when to stop washing, and we immediately know whether the powder meets quality standards,” an operator said.

The savings have been enormous, Ms. Rigaudeau said. In one year, the company reduced waste from the process by 73 percent, and water use has been cut drastically.

Samples from every batch no longer need to be sent to an off-site lab for testing, a process that could take between 24 and 48 hours. That has saved thousands of euros in lab costs, while decreasing gasoline consumption — from trucks that used to ferry samples to and from the lab — by 22 percent.

Let's recognize high gas prices as a regressive tax on the middle and working classes instead of memeing at truck owners. I don't begrudge the choices of others—if someone owns a big truck and foots the gas bill, it's no skin off my back. If a hypermiler goes on a hunger strike to eke out an extra 0.6 mpg on their family vacation, more power to them.

More anecdotes: I've filled the bed to capacity probably 100 times since I bought my Tacoma in the Spring of 2020. I've used the thing to move a house full of junk across Washington state, along with a thousand other adventures. Its tailgate has served as a picnic table while hiking in Idaho's Saint Joe National Forest; Its bed and a memory foam mattress have saved countless hotel fares during Lemons racing weekends; Its cabin has proved quiet and comfortable enough for dozens of cross-state trips, with acceptable leather seats, and tires aimed at all-season comfort with more than enough purchase for mountain passes and dirt roads. Sometimes it hauls two motorcycles.

I am not an exception to the rule.

Back at home, I got out the hose. The whole incident washed away in seconds.

This was a job for a pickup truck. A dirty, gross, unglamorous job, nothing like the slow-mo Like A Rock crooning that sells the idea of a pickup. While any other form factor could've done the job in an abstract sense, you'd have to be thicker than a wax ring to plop an ancient toilet into the carpeted hold of your RAV4, where its interior would face the sloshing mystery goop of 10,000 grandma farts.

So the answer is "yes," I do in fact need a pickup truck. Because as a homeowner, club racer, and person who spends their non-working hours actually doing things, a truck enables me like no other vehicle could.

Of course, the keyboard warriors have an answer for a single anecdote. It reads more like an accusation. "Okay, but how many times do you ackshually use your truck each year?" Like most Americans who own trucks, the answer is ALL THE DAMNED TIME. (Secretly though, the answer is, "None of your damned business.")
