Yet the week that the Lampard Inquiry heard about the lack of evidence for Oxevision (now rebranded as LIO health), Oxfordshire Mind accepted their money in a corporate fundraising/promotion deal. An outrageous and disappointing decision @mind.org.uk

A huge thank you to everyone at LIO Health for supporting Oxfordshire Mind at your Summer Party on 15th July!
It's fantastic to see so much enthusiasm for fundraising, with staff getting involved in the brilliant 'Take a Shot' envelope wall. For just £5, colleagues could choose an envelope for the chance to win a prize, there was also a chance to win a huge jar of chocolate footballs by guessing how many were in the jar. Really fun ways to raise vital funds while adding a little excitement to the celebrations!
£383 was raised on the day by staff which was very kindly matched by LIO Health bringing a grand total of £766.
We're incredibly grateful for your generosity and for your continued support of Oxfordshire Mind.
Partnerships like ours help us continue providing mental health support and services to people across Oxfordshire when they need them most.

“The Information Commissioner's Office has launched an investigation into the company behind Oxevision after campaigners called for an examination of the legality of its collection, processing, retention and access to patient data gained from use in the NHS”

Consent is not the only issue with Oxevision, with bereaved families and former patients with lived experience raising concerns about the safety, value and legality of surveillance technology in patient bedrooms, the impact on patient wellbeing and issues of privacy violation.
Oxevision's manufacturer says the tech allows staff to check patient vitals while minimising disruptions to patient sleep and facilitates "rich data collection"
There are also overlapping concerns about the intimate involvement of big tech companies like Palantir in the NHS, the risk of patient data being processed for commercial profit and the ethics of mass data collection - including movement and activity from clear video recordings, along with pulse and respiratory readings - from patients who are vulnerable, unwell and often detained under Mental Health Act powers.

“Rachel Harger, a partner solicitor at law firm Bindmans who is representing survivor-led campaign group Stop Oxevision, highlighted the ombudsman's findings in this case as "significant" because they “illustrate a pattern of basic safeguards not being met in the deployment of this technology".”

According to the ombudsman, the use of Oxevision "exacerbated her feelings of anxiety, vulnerability and fear" and it instructed Essex Partnership University NHS Foundation Trust to pay Miss B £925 'in recognition of the impact [she] has suffered"

Harger told Novara Media: "There is a clear legal risk that other NHS trusts using Oxevision in similar ways could face comparable complaints where patients are not properly informed, where consent is not meaningfully sought or respected, or where there is inadequate transparency about how the system is used in practice.
"The ombudsman's decision should not be viewed as an isolated outcome, but as an indication of broader legal exposure."

We are relieved to see that the Mental Health and Learning Disability Nurses Directors Forum guidelines on Oxevision have finally been taken down. We have long thought these guidelines were neither safe nor ethical. In particular their promotion of ‘implicit consent’ was outrageous

The two informed consent positions below each have advantages and disadvantages and need clarity and proper structure in their implementation to ensure the guidelines are followed.
1. Implicit consent: all service users are opted in upon admission as part of the standard practice on the ward. Service users can raise questions and concerns, and there should be regular opportunities for service users to be engaged by staff in conversation about their questions and concerns. Objections can be raised at any time. Objections should be handled by the responsible clinician as per existing clinical practice. The responsible clinician will decide whether to withdraw the use of the technology if in the best interest of the patient, taking into account the balance with individual preference, safety/risk management and other alternatives, just as

they would other treatment approaches. This approach needs open and honest communication including the frequent reiteration of the existence and purpose of the system so staff can be sure that patients' informed implicit consent remains in place.
The flowchart in Appendix 3 lays out how such a system can be maintained. It should be noted that most providers who have deployed VBPMS to date have made use of some form of this informed implicit consent model.

Are North London NHS Foundation Trust about to install Oxevision? This slide was shared with us recently. North London Trust is the merging of Camden and Islington with Barnet, Enfield and Haringey - the former of which stopped using Oxevision after complaints

Some examples
• We have started implementing Patient Knows Best that provides people access to information in their clinical records through the NHS app.
• We are using digital tools to record and analyse physical health observations on our wards
• Soon we will be able to order blood tests and receive results directly into our patient record system
• We are exploring digital tools to monitor vital signs of inpatients in a way that does not compromise their privacy and dignity but will save lives
• We will start using Artificial Intelligence tools to reduce the admin burden on staff to free up their time to spend with service users

It is important to remember that Oxevision DOES NOT sound an alert to a deterioration in vital signs. Staff can perform a manual spot check of pulse and breathing rate through the camera, which is reliable if the patient is still.

Answer
Oxevision does not continually collect data on pulse and breathing rate in a way that is reliable measuring or monitoring. The system will attempt to continuously gather pulse and respiration rate if someone is in the room and this data can be turned into a graph to identify trends. However Oxehealth states that this feature "cannot be used to measure or monitor pulse rate or breathing rate" and it "is not intended to be used as a continuous vital signs monitor". Despite confusion from both staff and patients, it's important to remember that Oxevision does not alert staff to a change in vital signs.
