Two Real Estate Investors Plead Guilty to Bid Rigging in Northern California

Investigations Have Yielded 62 Guilty Pleas to Date
Two real estate investors pleaded guilty for their role in conspiracies to rig bids at public real estate foreclosure auctions in Northern California, the Department of Justice announced.

Joseph J. Giraudo pleaded guilty to two counts of bid rigging, and Kevin B. Cullinane pleaded guilty to one count of bid rigging. Both were charged in an indictment returned by a federal grand jury in the U.S. District Court for the Northern District of California on October 22, 2014.

According to court documents, Giraudo and Cullinane participated in conspiracies to rig bids by agreeing to refrain from bidding against other co-conspirators at public real estate foreclosure auctions. Giraudo participated in conspiracies in San Mateo and San Francisco counties, and Cullinane participated in a conspiracy in San Mateo County. The conspiracies began as early as August 2008 and continued until January 2011.

The primary purpose of the conspiracies was to suppress competition in order to obtain selected properties offered at San Mateo County and San Francisco County public foreclosure auctions at noncompetitive prices.

Today’s guilty pleas are the result of the Department’s ongoing investigation into bid rigging at public real estate foreclosure auctions in San Francisco, San Mateo, Contra Costa, and Alameda counties, California. To date, 62 individuals have agreed to plead or have pleaded guilty.

These investigations are being conducted by the Antitrust Division’s San Francisco Office and the FBI’s San Francisco Office. Anyone with information concerning bid rigging or fraud related to real estate foreclosure auctions should contact the Antitrust Division’s San Francisco Office at 415-934-5300 or call the FBI tip line at 415-553-7400.

Very disappointed that @Scott_Wiener cancelled our interview. I had hoped to give him what the hecklers at the Trans march didn't: The chance to thoughtfully answer people critical of his views on Israel-Palestine. On an issue this weighty, avoiding hard questions isn't good politics. Nor does it show moral courage.

Members of the public verbally confronted Senator Scott Wiener about his policies in Dolores Park on Friday at the Trans March. Our safety team takes the safety and wellbeing of our participants very seriously. Scott Wiener was at no point in danger. Historically, the public has expressed their opinions to politicians at Trans March, as is their right.
In fact, Trans March has not featured politicians in our programming as a matter of policy since 2016, when Scott Wiener himself was criticized over housing, homelessness, and development issues; including supporting market-rate housing policies, opposing some tenant-backed measures, and receiving significant support from real estate interests. Trans March participants holding politicians accountable is nothing new.
Immediately following the incident, instead of engaging Trans March directly to resolve his concerns, Senator Scott Wiener's campaign went to social media and used the confrontation in fundraising communications. We are particularly disappointed that, while Senator Wiener continues to amplify this incident from Friday in national press interviews, he has failed to address the harm and disproportionate response from SFPD inflicted upon transgender people, children, families, and their allies on Friday night.
The role of Trans March and the greater movement for trans liberation is to focus on the material conditions affecting transgender people. Across the country, transgender people are facing an unprecedented wave of legislative and legal attacks on our rights and our humanity. Most recently, the Supreme Court allowed restrictions on transgender women participating in women's sports to stand, marking another setback that will have real consequences for transgender youth and adults alike
In moments like these, our community needs more than symbolic gestures, we need leaders who will speak up, invest in our communities, and take meaningful action to defend our rights and dignity.

This year's theme, "One Struggle, One Fight," honors the legacy of our ancestors. Following the example of Marsha P. Johnson and Sylvia Rivera, whose organizing recognized that liberation is built through solidarity, we continue to stand alongside immigrants, unhoused communities, anti-imperialist movements, social justice organizers, and all those working toward collective freedom.
Participation comes with shared expectations. Trans March is a community-led event rooted in transgender liberation. Everyone is welcome to participate, provided they respect our values, follow the direction of organizers and our safety team, and recognize that this space is led by and for the community. We welcome allies who come to listen, learn, and stand in solidarity because collective liberation remains our north star.
Trans March exists to build a world where all transgender and gender-nonconforming (T/GNC) people are safe, loved, and empowered. At a time when trans communities are facing escalating political attacks across the country, creating spaces where we can gather in safety, celebration, and solidarity has never been more important.
The San Francisco Trans March is far from just one day of programming, but rather a year-round organization for political education, trans empowerment, and community networking. We encourage everyone to get involved, whether that is sharing our mission, donating, volunteering, or attending our political education organizing meetings.
