20. The IIPA came into force on January 29, 2024. This means the act did not have legal effect until that date. I acknowledge that IIPA section 23 says the act retroactively applies to distributions that occurred after the act’s first reading, which was March 6, 2023. However, the applicant could not apply to the CRT for protection orders and damages until the legislation came into force. Put another way, the applicant could not apply for remedies under the IIPA until it took effect on January 29, 2024. Given this, I find the applicant could not reasonably know that a CRT proceeding was available for these statutory remedies until January 29, 2024.

21. If I accepted the respondents’ argument that the limitation period started running before the IIPA came into force, it would mean claims that arose on March 6, 2023, would only have a 13-month window for a party to bring a claim. A principle of statutory interpretation is that the legislature does not intend to produce absurd consequences. See Rizzo & Rizzo Shoes Ltd. (Re), 1998 CanLII 837 (SCC) at paragraph 27. Without a clear intention to do so, I find it would be absurd if the legislature intended to reduce the limitation period for these claims. So, I find January 29, 2024, was the date the applicant discovered her claim. This means she needed to apply to the CRT for dispute resolution by January 29, 2026.

22. For the damages claim, the applicant submitted a Dispute Notice on January 22, 2026. However, I find she did not satisfy the requirements for applying to the CRT until March 10, 2026. To apply for dispute resolution, CRTA section 4(2) and CRT Rule 2.1(1) say an applicant must both give the CRT a completed CRT Dispute Application Form, and they must pay the required fee. Here, the applicant did not pay the application fee until March 10, 2026.

23. I acknowledge that the CRT did not request payment for CRT fees until February 24, 2026. However, this does not change that the applicant was obligated …

Despite the high rates of IPV in our society, human rights law in BC and across Canada has rarely addressed discrimination against IPV survivors in the workplace.

This case is an opportunity for the BC Human Rights Tribunal (the Tribunal to consider how the gendered and systemic nature of IPV can lead to workplace discrimination, affecting survivors’ economic security and equality. It may also clarify what obligation employers have to accommodate workers who are impacted by IPV and recognize their distinct needs in the workplace.

The complainant experienced brain injuries from intimate partner violence, was demoted to a casual position in 2019 and then casual positions were laid off in 2020. Another far too long road to the possibility of some justice. It appears Translink was very aware of the IPV & effects the whole time

Did some more research by spoofing user agent strings and logging in vs out - it's even more complicated. Logged in chrome and firefox/variants gets the correct result, logged out does not. Logged out: -Edge - once correct, another time wrong! -Safari - wrong but different -Chrome - wrong

This day in forced Google AI, part 2 The exact same search in different browsers returns completely different and completely contradictory AI results. Chrome on left (correct), Firefox on right(not). I heard this was a thing so I checked. Utterly shocking.
