history and precedent, and by the weighty and thoughtful
dissents, the constitutional issue is far more complicated
than the statutory issue. After reading those scholarly
opinions, one thing seems evident: The constitutional issue
is not straightforward, much as we might want it to be.
That is another reason why, in my respectful view, the
Court should have decided the case on the narrow and
straightforward statutory ground. In any event, because
the Court addresses the Constitution, and because I
respectfully disagree with its analysis of that highly
consequential issue, I too will briefly address it.
Ratified in 1868, the Citizenship Clause of §1 of the
Fourteenth Amendment provides: “All persons born or
naturalized in the United States, and subject to the
jurisdiction thereof, are citizens of the United States and of
the State wherein they reside.”
In 1898, as noted above, Wong Kim Ark interpreted the
Fourteenth Amendment’s “subject to the jurisdiction”
language to provide a general right of birthright citizenship
with four disparate exceptions—for “children of foreign
sovereigns or their ministers, or born on foreign public
ships, or of enemies within and during a hostile o

The only
apparent principle unifying the four disparate exceptions
listed by the Court in Wong Kim Ark—especially in light of
the exception for tribal American Indians—is that the
parents in all of those varied circumstances were not U. S.
citizens and were citizens of other nations, whether tribal
or foreign. Cf. post, at 3–22 (ALITO, J., dissenting). An
exception for those born in the United States to foreign
parents unlawfully or temporarily in the country is
consistent with that principle and therefore with the
Fourteenth Amendment.6
All of that said, as noted above, Congress in 1940 and
1952 enacted a statute, §1401(a), that at the time and since
has always been understood to authorize only the four
Wong Kim Ark exceptions. If Congress amends §1401(a) or
otherwise enacts a statute creating new exceptions along
the lines of the Executive Order for children born to foreign
citizens unlawfully or temporarily in the country, such a
statute, as I see it, would pass constitutional muster.7

A fervent proponent of deregulation during his 18-year tenure at the Fed's helm, Greenspan has faced mounting criticism this year for having refused to consider cracking down on credit derivatives, an unchecked market whose excesses partly led to the current financial crisis.

Although he defended the use of derivatives in general, Greenspan, who left office in 2006, told members of the House Committee of Government Oversight and Reform that he was "partially" wrong in not having tried to regulate the market for credit-default swaps.

But in a tense exchange with Representative Henry Waxman, the California Democrat who is chairman of the committee, Greenspan conceded a more serious flaw in his own philosophy that unfettered free markets sit at the root of a superior economy.

"I made a mistake in presuming that the self-interests of organizations, specifically banks and others, were such as that they were best capable of protecting their own shareholders and their equity in the firms," Greenspan said.

Referring to his free-market ideology, Greenspan added: "I have found a flaw. I don't know how significant or permanent it is. But I have been very distressed by that fact."
Waxman pressed the former Fed chair to clarify his words. "In other words, you found that your view of the world, your ideology, was not right, it was not working," Waxman said.

"Absolutely, precisely," Greenspan replied. "You know, that's precisely the reason I was shocked, because I have been going for 40 years or more with very considerable evidence that it was working exceptionally well."

There’s been some debate about whether the Juneteenth flag is the most appropriate symbol for the holiday. Haith said he understood why people could have some hesitancy around commemorating the freedom of slaves by using a red, white, and blue flag, which some see as a tribute to the oppressors of Black Americans.

“Some of us were raised to recognize the American flag, we salute the American flag, we pledged allegiance to the American flag,” Haith said when asked of the skepticism around the flag he created. “We had relatives who went to war to fight for this country. We put a lot into this country, even when our ancestors were enslaved. They worked to help make this country an economic power in the world.”

A fund-raising letter written by the television evangelist Pat Robertson in opposition to a proposed equal rights amendment to the Iowa Constitution suggests that feminists want women to kill their children and practice witchcraft.

The equal rights amendment, on which Iowans will vote Nov. 3, is a broadly worded measure that would bar sex discrimination.

But Mr. Robertson's letter, distributed late last month to supporters of the evangelical organization Christian Coalition, described the proposal as part of a "feminist agenda" that "is not about equal rights for women." Claims of 'Anti-Family'

Instead, the letter said, "it is about a socialist, anti-family political movement that encourages women to leave their husbands, kill their children, practice witchcraft, destroy capitalism and become lesbians."

Mr. Robertson, a 1988 Republican Presidential contender, included in the letter a plea that money be sent to the organization Stop E.R.A. to "help defeat E.R.A. and defend the family in Iowa."

Betty Durden, head of the group Iowa Equal Rights Amendment 1992, said Mr. Robertson's letter was "ridiculous."

But Ione Dilley, a member of Stop E.R.A. and chairwoman of the Iowa Christian Coalition, said that although she would not defend Mr. Robertson's references to child-killing and witchcraft, he was correct about hidden agendas.

She said her proof came from a hearing called by state officials seeking opinions on how the amendment should be summarized on the Iowa ballot. She said the meeting had been attended by officials for the National Organization for Women, Planned Parenthood and "the homosexuals."

"If this resolution to change our Constitution were not vital to them," Mrs. Dilley said, "why would they show up at this hearing?"

Lee was convicted of mass murder for his complicity in the 1857 Mountain Meadows Massacre.
The Mountain Meadows Massacre (September 7–11, 1857) was a series of attacks during the Utah War that resulted in the mass murder of at least 120 members of the Baker–Fancher wagon train. The massacre occurred in the southern Utah Territory at Mountain Meadows, and was perpetrated by settlers from the Church of Jesus Christ of Latter-day Saints (LDS Church) involved with the Utah Territorial Militia (officially called the Nauvoo Legion) The wagon train, made up mostly of immigrant families from Arkansas, was bound for California, traveling on the Old Spanish Trail that passed through the Territory.
This event was part of the Utah war, was an armed confrontation between the armed forces of the US government and the Mormon settlers in the Utah Territory. The confrontation lasted from May 1857 to July 1858. The conflict primarily involved Mormon settlers and federal troops, escalating from tensions over governance and autonomy within the territory. There were several casualties, predominantly non-Mormon civilians. Although the war featured no significant military battles, it included the Mountain Meadows Massacre, where Mormon militia members disarmed and murdered about 120 settlers traveling to California with tensions from the Utah War being cited as a contributing factor to the massacre.
