I have a Keycite alert for Obergefell and Bostock and see stuff like this constantly from certain judges--gratuitous citations to the dissents for no apparent reason other than to signal dislike of those decision. This particular case is about Iowa environmental law. It's wildly inappropriate.
Contra this concurrence from Thomas and Barrett, isn't that exactly what courts are told to do under existing severability doctrine? i.e. Ask whether “it is evident that the Legislature would not have enacted those provisions which are within its power, independently of that which is not.”
