Yet, hidden within the draft law on chat control is a perhaps even more perfidious attack on freedom—a clause with the potential to destroy the internet as we know it: The opening of an email or messenger account is to require mandatory age verification. What sounds like a technicality is actually political dynamite. It spells the end of the right to anonymous digital communication. Anyone wishing to use WhatsApp, Signal, or even a simple email inbox in the future will have to show their ID card or their face.

A whistleblower wishing to remain anonymous for fear of investigation will hardly dare to tip off a journalist about government corruption if they have to upload their ID to a database to do so. They are effectively being silenced. Investigative journalism, anonymous pastoral care, and confidential counseling in crisis situations will become impossible. Furthermore, it is only a matter of time before these internet ID databases are hacked, opening the floodgates for criminals to commit identity theft. Our security is not being protected here; it is being endangered. Moreover, a new bureaucratic monster is being created. While the economy groans under the weight of regulations, European tech start-ups and companies are being forced to implement complex new verification systems.

Implications on AI Act
Another key regulation being targeted is the AI Act which provides guardrails for the development and use of artificial intelligence. The harms we all face from AI systems that this law could help protect against are massive. In Denmark, the authorities have rolled a new AI-powered system to detect cases of fraud in their social benefits system. Instead of anticipated benefits, Amnesty International’s research found that – as is so often the case with such systems – human rights ended up being undermined.

The system used variables such as links to foreign countries, or “unusual” housing compositions to flag potential cases of fraud, and this ended up disproportionately targeting people of migrant backgrounds and anyone who’s way of life deviated from what was deemed as the ‘norm’ in Danish society. These people, as well as other members of marginalized groups, wound up being subjected not only to digital surveillance using their personal data, but also invasive analogue forms of surveillance such as so-called “duvet-lifting” aimed at determining whether a person might be cohabitating with a partner.

"The good news is that the blocking minority held. Members states raised concerns about privacy and cybersecurity as reasons for their opposition. Even countries that are officially in support of the proposal asked questions along these lines for the first time – showing that they are facing increased pressure back home.

The bad news is that #Denmark is moving forward even though they did not receive full support. They are keeping their plan to take this proposal to the Justice and Home Affairs Council meeting on October 14th.

After discussing with partners, we understand this as a strategy from Denmark. They are not making progress at the working level (the meeting today) and therefore will try directly at the political level (justice and home affairs). During these coming four weeks they will try to convince some of the blocking member states to reconsider their position.

What this means for us is that we need to keep up the pressure. We should be thanking the blocking countries for their position and encouraging the undecided or supportive countries to reconsider. We should keep up pressure in the media at the same time."
