The judgment explains that: ‘it may be that some persons who hold / manifest such beliefs have such animus, but it is stereotyping to assume that all do.

2.40 The Act protects people from victimisation when they have done a protected act. This protection applies irrespective of their protected characteristic.

Examples

The Independent article on this is even more absurd, because alongside the OfS and Phillipson citing "concerns about foreign interference" there are comments from Free Speech Union; an org of eugenicists and gender criticals that's funded by Peter Thiel as well as Viktor Orban's MCC think tank.

The Office for Students (OfS) will oversee this "first-of-its-kind" scheme, launching from the upcoming academic year. It will allow university staff, external speakers, and non-student members to report concerns regarding providers in England, according to the Department for Education (DfE).

The higher education regulator will investigate these complaints, with powers to recommend that universities review decisions, offer compensation, or enhance their existing processes.

From next April, new registration conditions will enable the OfS to fine universities for breaches of their Freedom of Speech Act duties. Penalties could reach £500,000 or 2 per cent of income, and severe cases may result in deregistration, risking public funding loss.

The OfS said it has received reports of speakers and lecturers being “harassed and blocked” because of gender-critical or religious views, concerns about foreign interference restricting academic freedom, and job adverts requiring specific ideological beliefs.

“It is important that the OfS discharges its new responsibilities fairly, transparently and proportionately.”

Lord Toby Young of Acton, director of the FSU, said that while the new complaints system is “welcome news”, it should be open for students to use as well.

He said that the FSU will “continue to campaign for their inclusion”.

The Free Speech Union (FSU) said nearly one in 10 of the 5,700-plus cases it has fought over the past six years involved universities “failing to protect free speech”.

Education Secretary Bridget Phillipson said: “Freedom of speech is the foundation of every university’s success, enabling them to foster robust debate and exchange challenging ideas respectfully.

“But there are far too many cases where academics and speakers are being silenced, inciting an unacceptable culture of fear and stifling the pursuit of knowledge.

Considering that this is quite literally contained within the Forstater judgement (which established Gender Criticalism as a protected belief).... I don't see how this ruling is anything except a miscarriage of justice, even by the pro-GC standards of the courts.

This judgment does not mean that those with gender-critical beliefs can ‘misgender’
trans persons with impunity. The Claimant, like everyone else, will continue to be
subject to the prohibitions on discrimination and harassment that apply to everyone
else. Whether or not conduct in a given situation does amount to harassment or
discrimination within the meaning of EqA will be for a tribunal to determine in a given
case.

Many people have asked to see the motion that Cllr Dulston and I put forward at Full Council. A motion that led to us being branded every insult in the modern lexicon—some contradictory, some imaginative, all delivered with the fervour of people who have long since stopped listening. Those people are your councillors.
I got bigot, transphobe, homophobe, misogynist, fascist, scumbag, cis man, and my favourite, witchfinder general. All from your elected representatives, all because we want to protect women and girls.
One cabinet member (pronouns They/Them) was so distraught I thought "they" were going to dissolve right there on the chamber floor—melt into a puddle of righteous indignation and procedural despair, leaving nothing behind but a lanyard and the faint smell of herbal tea. You'll be glad to know that 10 minutes later, when "they" delivered "their" report, "they" were as happy as a lottery winner on a three-day bender—beaming, buoyant, utterly reborn.
The transformation was so complete it felt chemically assisted, as if someone (possibly the Greens) had slipped a fistful of drugs into her one-litre water bottle. But alas, no, it was just the same old performative nonsense.
So the motion is below... clean, simple, almost offensively reasonable—it is titled Women’s Privacy, Dignity, and Safety Across Darlington.
A title so benign it could lull a charging bull into quiet reflection. The aim? To implement the Supreme Court ruling clarifying that, under the Equality Act 2010, “sex” refers to biological sex. Sensible stuff. Dry as toast, but necessary.
I worked with the Tories—yes, strange bedfellows—to craft something measured, respectful, bulletproof. No rights stripped, no torches lit. Just a line in the sand. But that wasn't enough for Labour and the Greens, they want men to be in women-only spaces and they will do anything to make that happen.
Does any of the motion scream that the authors are bigots/ transphobes/homophobes/misogynists/fascists?*

6. Wait before considering a request
Schools are also told to allow for “watchful waiting” before considering a request, “to ensure it is a sustained and properly thought-through decision”.

They should consider if the child has made “similar requests” before, and seek to understand factors that may have influenced the child, such as their “peers or social media”.

The guidance also asks schools to consider whether a child feels “pressured” to identify differently because they “simply do not align” with stereotypes associated with their sex.

Other factors listed for consideration are whether input from a special educational needs coordinator is “appropriate”, or if there is an “interaction” with the child’s sexual orientation.

7. Factoring in other pupils and staff
When considering requests for social transitioning, schools are told to consider the impact on other pupils, including safeguarding concerns.

Schools may conclude that the impact on the school community “is such that it may not be possible to agree to support a request”.

If a change has been agreed, schools should communicate this to other pupils and staff “where it is necessary and proportionate to do so”.

But the guidance adds that “this should be done sensitively, without implying contested views around gender identity are fact”.
