Worth highlighting what to me is the most telling sentence in Roberts' opinion in birthright citizenship case (see screenshot). Translation: "Give us a better reason to take another look at Wong Kim Ark and we will do it." And that's what Johnson is doing here. Here we go.

What the Court held in Wong Kim Ark was simple: the Citizenship Clause incorporated the common law and
granted citizenship to nearly all children born in the United States. Not surprisingly, then, in the 128 years since, we have repeatedly understood the rule of Wong Kim Ark to
guarantee citizenship to all children born in the United States and subject to its power. See, e.g., United States ex
rel. Hintopoulos v. Shaughnessy, 353 U. S. 72, 73 (1957); INS v. Rios-Pineda, 471 U. S. 444, 446 (1985). We see no
reason to depart from that view today.

From NYT Op-Ed: "The Justice Department policy that spared Mr. Trump this possible fate — the policy against prosecuting sitting presidents — originates in a legal opinion that the department’s Office of Legal Counsel wrote in 1973 and reaffirmed in 2000. It stems mainly from the concern that requiring a president to answer criminal charges would compromise his or her ability to discharge the duties of the office. The department’s lawyers reasoned that it would be “incongruous” to allow a jury of 12 citizens to interfere so profoundly with a president’s ability to govern. They concluded that if a president’s mandate was to be terminated, it should be through impeachment."

At a complete loss to understand how the author here believes that Blanche and Bove acted with contempt and yet doesn't think there should be a criminal contempt inquiry. If they violated the law, they should face the consequences. Why hedge on that?

That said, no matter how the D.C. Circuit decides to deal with the rehearing petition, or how the court resolves the mandamus question if it grants rehearing, the most important thing the court of appeals can and should do is to make unequivocally clear—or permit Chief Judge Boasberg to do so—that Blanche and Bove’s actions last March were egregious violations of the rule of law and sharp deviations from essential DOJ norms of candor and comity.

We are 6 years removed from Jan. 6. This is not a 'worry', it's a reality. DHS *will* put its thumb on the scale this November, as will the post office and other federal agencies in whatever way they can. Voters should act accordingly and take nothing for granted.
