Unreasoned orders deserve exactly zero respect from any lower courts not directly addressed by those orders. The Supreme Court itself said as much just this summer.

Sotomayor is pretty convincing on this point in her Slaughter dissent. The Framers were clear that the President could never be a king. If the office Trump holds wields powers that eclipse those of the English crown at the time of our founding, that office must be something other than President.

This is the specific news item I’m pressing on: federal legislators from his Kentucky delegation, in concern for their constituents rights of representation, are in serious enough doubt that they are publicly expressing concern. Whose judgment should matter here? Yours?
This proposal is anti-democratic. The ppl who risk going unrepresented if an incapacitated lawmaker remains seated are their constituents. The lawmaker’s duty is to them. Potential vacancies must be assessed by reps accountable to them—and this duty is assigned in the Constitution to state governors
Well-put. What’s missing now is not the work of deconstructing UET. That’s done. What’s needed is work constructing a counternarrative. (As Prof. Baumann has argued elsewhere.)

Disagree. Public meetings & public comments at the level of implementation aren’t solely a hack for our broken system. Our system broke down precisely bc our representative assembly unconstitutionally abandoned them Elections are necessary for democratic governance but they are not alone sufficient
