Yes, a temporary replacement is appointed by the Governor until a special election is held. When a U.S. Senator from Oklahoma resigns, the Governor must appoint a qualified person to serve temporarily while a special election process is conducted to fill the remainder of the term.
Immediate Appointment Process
According to §51-10 of the Oklahoma Statutes, when a vacancy occurs in the office of a U.S. Senator from Oklahoma, the Governor must take action within 30 days of the vacancy occurring. The Governor shall:
• Appoint a person eligible to hold the office
• The appointee must have been a registered voter of the same party as the predecessor in Oklahoma for at least 5 years preceding the date the vacancy was created
• This person serves in the Senate position temporarily
Special Election Requirements
According to §26-12-101 of the Oklahoma Statutes, the special election to permanently fill the vacancy must follow specific procedures:
Election Timing:
• A Special Primary, Runoff Primary, and General Election shall be held concurrently with the next available regularly scheduled statewide Primary, Runoff Primary and General Election
• A special candidate filing period occurs on the same dates as the regular filing period
Current Situation (March 5, 2026): Since the senator was already up for re-election this year, the special election process would align with the regularly scheduled 2026 election cycle. The temporary appointee would serve until the winner of the special general election is certified and takes office.
