Some organisations such as the Women's Institute and Girl Guides have already made the decision to restrict membership to biological women only. The Code does explain where membership could be restricted based on sharing multiple characteristics and therefore provides and opportunity for trans inclusion, e.g. a women and trans women association.

The last sentence of this is particularly evil: 'you could make all spaces unisex, but here's an implicit threat of legal action if you thought this might be a way to make your service trans inclusive'.

Text reads: 'it is not compulsory for services that are open to the public to be provided on a single-sex basis or to have single-sex facilities such as toilets. These can be single-sex if it is a proportionate means of achieving a legitimate aim and they meet other conditions in the Act. However, it could be indirect sex discrimination against women if the only provision is mixed sex.
