Subject: Overview of the upcoming Early Assistance meeting with McCall Terminals and PP&D
Background
McCall Terminals will meet with Portland Permitting & Development (PP&D) - alongside the Bureau of Planning & Sustainability (BPS),and Portland Fire & Rescue (Fire) - on July 28 for an optional early assistance to discuss the potential permitting and land use needs associated with their proposal to demolish an existing building on their property in order to extend rail infrastructure onto an adjacent property, as well as associated site, utility, piping, electrical and operational improvements.
A preliminary and unofficial review by PP&D's land use team of the application materials indicates a land use review may not be required. This pre-application conference will allow this team to further explore these pre-application materials in discussion with representatives from McCall Terminals.
McCall Terminal's Proposal
Per the pre-application materials submitted by McCall Terminal, they are proposing "an extension of the existing rail infrastructure at the NW Front Avenue terminal in Portland, Oregon. The project would include demolition of an existing building [noted 'A' in the image below*), extension of the rail yard (current rails noted 'B' in the image below*) onto the adjacent property, installation of new rail infrastructure for loading and unloading asphalt and liquid fuel product, and associated site, utility, piping, electrical, and operational improvements (general area where work will happen noted 'C' in the image below*]."

Both properties are private property owned by McCall Terminals, though the adjacent property is currently operated by Brenntag Pacific. Per pre-application materials, "The proposed improvements would increase operational flexibility and improve the terminal's ability to receive, stage, load, and unload asphalt and fuel products by rail. The Project would include demolition of the existing Brenntag building, improvements to rail infrastructure, new rail loading and unloading infrastructure, utility upgrades, stormwater improvements, and associated operational infrastructure."
Early Assistance Meeting Details
This online meeting is scheduled for Tuesday, July 28 at 10:30 a.m. for a 90-minute meeting. Participants of the meeting will include representatives from McCall Terminals, PP&D, BPS, and Fire.
The meeting will be publicly posted on Friday, July 17. The public is welcome to attend the meeting via the Zoom webinar; however, they will not be able to provide comments or otherwise participate in the meeting.
Potential Land Use Review
While we are too early in this process to make an official determination of what types of review will be needed, an early look at materials provided by McCall Terminals indicate a land use review may not be needed for this project.
Based on these details, should a review be needed, it would likely be a Type II Greenway review. Greenway Review is required for many projects that occur within the Greenway overlay zones (''n", "r", 'g", "i", and "q" overlays). The Greenway Review is required to address issues of public access,

Decision Making Authority
In the Type Il procedure, the decision is made by PP&D staff. Upon receiving a complete application, notice of the applicant's request is mailed to all property owners within 150 feet of the site. Notice is also sent to the recognized associations within 400 feet of the site. The public comment period is 21 days. A decision will be made within 28 days of receiving a complete application. Once a decision has been made, a notice is mailed to all property owners within 150 feet of the site, to recognized organizations where the site is located and those located within 400 feet of the site, as well as to any person who submitted written comments.
The decision may be appealed by anyone, including the applicant, within 14 days of the mailing of the notice of decision. Generally, there is a fee for appealing the decision. However, there is no fee for organizations recognized by the Office of Neighborhood Involvement (typically neighborhood associations, district coalitions, and business district associations) appealing a land use decision for property within the organization's boundaries. The vote to appeal must be in accordance with the organization's bylaws.
If the decision is appealed, notice of appeal will be mailed within five days and there will be a public hearing scheduled within 21 days of that mailing. The hearing will take place in front of the Hearings Office. The decision of the Hearings Officer is final at the local level but may be appealed to the State Land Use Board of Appeals (LUBA).
Next Steps
Following the meeting with McCall Terminals on Tuesday, July 28 at 10:30 a.m., written responses are completed by City reviewers identifying regulations that apply to the project. PP&D will continue to work with the team, should they choose to pursue the project and apply for relevant permits. Depending on what they ultimately decide to pursue, it may or may not trigger a land use review.

Instead, we’re seeing a pressure campaign directed at council begging for a shot at a fair deal on short timeline. Dismissing that as “opportunistic techbro behavior” is bizarre, but also reveals a troubling insight into how the Mayor views public criticism, which is beginning to form a pattern.

It's easy to be against transformational civic projects. There are risks, though a renovated arena holds far fewer risks than constructing a new one. Calling foul and throwing around accusations can boost re-election campaigns but we can't wave away the very real risk of declining tax revenue, broken promises to neighborhoods, and lost jobs. Big projects like this also attract opportunists, such as the Brooklyn-based techbro using our city's dilemma to pitch his 'civic engagement' dot-com startup. (He reached out to me and offered to personally deliver 10 city council votes if I used the 'term sheet' he developed.)

I expect the primary objection to our amendment will be that it spends money now that we may need in next year’s budget. I’ll note that the city just published for the first time details regarding the Mayor’s proposed sources of funds for Moda remodel that anticipates $45 million in BLT.

How will the City pay for its share?
City Council will have to approve any City dollars that are spent on the project, and has not deliberated or made any decisions yet.
Some options that have been suggested include:
• The City is anticipating $45 million in tax revenue from the sale of the Portland Trail Blazers from the estate of Paul Allen to the new owners. This revenue is not currently allocated to any future expenses and could go towards the $120 million the City would invest in the Moda Center.

Legislative Concept
Rates are designed with fixed and variable charge components. The fixed component is a flat rate per unit per billable account, while the variable component is a flat rate per 100 square feet of utilized zoned land (with regards to billable accounts). Furthermore, the variable component will apply to all zoned land.
Utilized zoned land usage means the total buildable land in the parcel divided by the number of billable units on the land. For example, if you have 10,000 SQFT of buildable land on the parcel, with 100 units with billable accounts, then the utilized zoned land is 100 SQFT per unit.
Proposed two-part rate structure
Flat fee component: The flat fee will be assessed at $3 per unit per billed account on a monthly basis.
Variable fee component: Variable fee will be assessed at $0.10 per 100 SQFT of utilized zoned land usage for each billable account on a monthly basis.

A Message from Councilor Green
Dear Portland,
Last week I was made aware of the mind-blowing fact that the Portland Housing Bureau is currently sitting on upwards of $106 million in unspent funds.
This is money intended to create and preserve affordable housing, to prevent homelessness, and to provide stability for our most vulnerable neighbors. The fact that it has been sitting idle, hidden from public view and even from the City Council itself while we debate cuts to beloved programs, and while more Portlanders fall into homelessness every single day is frankly shocking. This profound failure of transparency and accountability highlights deep, systemic problems within our city's administration.
One of the roles the City Council is tasked with in our new charter is to perform oversight to ensure that City policies are carried out effectively and efficiently. And that’s exactly what I intend to do.

When the initial $20 million was discovered late last year, I immediately pushed for a Council investigation to find out how this happened and who knew about it. At that time, I needed eight colleagues to vote for oversight. I did not receive that support. Last week, on February 4th, after more funds were reported (but before the staggering total was known) I brought my oversight resolution back before the council. Despite continued opposition, we finally passed it.
Formal oversight is not about blaming individuals, or even bureaus. It’s about transparency. If we’re going to fix what is a clearly broken system, we need to see where things have gone wrong in the past. And if we want to begin to repair the loss of public trust that this episode has surely engendered, we need to do this work in public.
For too long, under the old form of government, bureaus operated in silos with little coordination or public accountability. This $106 million is a relic of that system. My resolution mandates the release of all related public records and will trigger the first formal oversight hearing under our new charter. Portlanders deserve answers.
But we also need action, and we need it with the urgency this crisis demands. It is scandalous that this money has been withheld while the human cost of our housing crisis mounts. The real issue here is that we are not getting resources into the hands of those who need them most, nearly fast enough.

$That is why I’m also pushing to move swiftly to disburse the initial $21 million for critical, life-saving interventions like eviction protection and legal services, emergency rental assistance, and most of all, rent buy-downs for existing affordable housing. Rent buy-downs are the most cost-effective, immediate, and long-lasting tool we have right now. Here’s how they work: non-profit affordable housing providers carry high debt, which forces them to charge rents near market rates. For about $60,000 per unit (a fraction of the $600,000+ it costs to build one new unit) the City can buy down that debt, with a mandated, permanent reduction in rent for the tenants. We can lower rents on these units by around 18% immediately, keeping hundreds of families housed now and for years to come. This is a direct investment in people, not a subsidy to for-profit landlords. This method also helps address the shocking vacancy problem in some affordable buildings, where units sit empty because the rent is set too high for the people who need them most. This moment must be a turning point. This Council must move quickly to get these funds out the door. We must begin to restore public trust through oversight and reforms that will surely follow. Because only then will we be able to begin the vital work of transforming our housing system from one that treats homes as speculative commodities into one that guarantees housing as a human right. We need a model that builds housing for people, not portfolios. That model is called Social Housing. It’s high-quality, permanently affordable housing at all ages, wages, and stages of life, that would serve most people and families in Portland. It’s a heavy lift, and it’s time to get started. The amendment that we are filing simply adjusts the dates as follows. It is important to give the City Administrator and Council Ops staff sufficient time to accommodate this discovery work.

BE IT FURTHER RESOLVED, the City Administrator shall share a complete set of the above-described public records identified by the City Administrator with Council and Council Operations no later than February (delete 6th and add 20th), 2026; and

BE IT FURTHER RESOLVED, Council Operations shall compile all available information, accounts, records, and communications shared by the City Administrator, Council Offices, journalists, and other relevant parties. Council Operations shall share this compilation with Council no later than (delete 13th and add 27th), 2026, distinguishing the set of public records described above provided by the City Administrator from all other information provided by other sources; and

BE IT FURTHER RESOLVED, the Council President shall schedule an initial oversight hearing to invite testimony of relevant individuals and consider all findings, no later than (delete February 20th and add March 6th), 2026, and schedule subsequent oversight hearings to consider additional investigatory action by Council if necessary, in the interest of working toward conclusory findings in aid of Council's legislative function.

I'm just a dumb idiot when it comes to transportation planning, so I'll take my lashings on this if I'm wrong. But, I do know how to interpret a time series chart. I see clear seasonality in ridership during the cold & raining months. Surely insufficient stop infrastructure plays a role in that.

Today I filed a resolution intended to pursue Council oversight into the matter of the $21M that was found in the Portland Housing Bureau but not disclosed to Council ahead of budget discussions. I'm joined by @councilormorillo.bsky.social and @counciloravalos.bsky.social as co-sponsors.

Require the City Administrator to release all relevant public records in reference to recently discovered unspent surplus funds and schedule an oversight hearing to facilitate fact finding

WHEREAS, Council was first notified of the potential for a budget deficit to be balanced in the Fall Technical Adjustment Ordinance (TAO) on August 8th, 2025; and

WHEREAS, following the passage of the Fall TAO, the Deputy City Administrator (DCA) of the Community and Economic Development Service Area (CEDSA) notified Council of previously undiscovered funds available for housing related use on November 20th, 2025; and

WHEREAS, reporting on the matter of the funds has raised significant public interest in the timeline related to the fund discovery, its relation to TAO development, and why City Council was not notified of these funds prior to Council consideration of the TAO; and

WHEREAS, Council expects that information from bureaus will be readily available upon request in order to aid in effective legislative oversight;

NOW, THEREFORE BE IT RESOLVED, Council exercises its investigatory authority in aid of its legislative function granted by the Charter and directs that the City Administrator shall release all relevant public records subject to disclosure under the Public Records Act, including without limitation communications and other information pertinent to understanding the following questions:

1. What happened to the funds and what led to them not being spent in previous years?

2. Who was aware of the funds, at what point in time was each party made aware, and why was Council not informed in a more timely manner?

3. What dynamics led to this information not being shared with Council, and what was the sequence of events, given that Council has received differing accounts of what occurred?

4. To what degree were decisions made around these funds and when information was or wasn’t shared, as it pertains to development of the Fall TAO proposal?

“We have seen ICE and the National Guard perform homeless sweeps in other cities where
they've been deployed, and we’ve heard Trump calling for increased sweeps and even
disappearance of unhoused people.
It is a bad, cruel, and failed policy when the Trump administration does it, and it is a bad,
cruel, and failed policy when the city of Portland does it.
As we face the very real possibility of federal troops being deployed to our streets to target
one group of vulnerable people, we absolutely cannot start using our own police to do their
work for them by targeting another.
Some will argue that sweeps are about safety and compassion, but the evidence is clear
and overwhelming. Sweeps kill people.
For far too long, Portland has pursued a failed policy of criminalizing poverty. As a result,
we’ve spent hundreds of millions of dollars only to see the problem grow, and deaths among
our homeless neighbors quadruple between 2019 and 2023.
It’s time to change direction. We need to protect ALL Portlanders.

We need to focus on programs that move people closer to housing and stability, not policies
that punish and further destabilize. Programs like low-barrier jobs programs, direct rental
assistance, food aid, and day shelters that provide hygiene, clothing, and case management.
Programs like these are humane, cost-effective, and they work. They address the issue of
visible poverty that neighbors and businesses are concerned about, but they do so by
offering dignity, not displacement. They break the cycle of disappointment and
depression—where people spend all day waiting in lines, worrying about their belongings,
with no meaningful work. They are a hand up, not a sweep away.
But at the end of the day, the only real, lasting solution to homelessness is to provide deeply
affordable housing for all. Unless we stop the flow of folks onto the streets, we’re never
going to make real progress. That is why we need to move aggressively towards a Social
Housing model— high quality, permanently affordable housing that will serve the vast
majority of Portlanders, from the unhoused to the middle class.
The choice before us is clear. We can either align ourselves with the politics of division, of
sweeps, of cages, and of death, or we can choose the politics of solidarity, of housing, of
healthcare, and of life.”
