As I always say, we are suckers for knowledge.

You say that to opine "about which side was correct in its originalist analysis" would be
"a breach" of your "duty of epistemic responsibility." But if the question is easy, isn't it part of your epistemic duty to say so? 1/2

And if it is hard—in this case, where the constitutional language and historical context are uncommonly clear-doesn't that render constitutional meaning indeterminate even in the easiest cases? 2/2

I’m a little shook. Larry Solum just blocked me, after an extended back and forth. Here I think were my offending replies:

I am trying to engage on a narrow point with precision.
The point raised was about justified opinion, not opinion simpliciter. Is your opinion justified? If so, it seems odd not to share it.

I don't buy that academic norms cut against venturing a tentative, appropriately hedged opinion on a question within one's own field.

But it you do, that probably gets at the core of our disagreement. I take epistemic justification to be highly socialized, with academic intuitions providing valuable epistemic cues—cues that help laypersons evaluate the significance, seriousness, and reliability of challenges to longstanding expert consensus, whether that be anthrogenic climate change, vaccine efficacy, or the meaning of the Citizenship Clause.

MLK’s takedown of the white moderate remains undefeated.

First, I must confess that over the last few years I have been gravely disappointed with the white moderate. I have almost reached the regrettable conclusion that the Negro’s great stumbling block in the stride toward freedom is not the White citizens’ “Councilor” or the Ku Klux Klanner, but the white moderate who is more devoted to “order” than to justice; who prefers a negative peace which is the absence of tension to a positive peace which is the presence of justice; who constantly says “I agree with you in the goal you seek, but I can’t agree with your methods of direst action” who paternistically feels that he can set the timetable for another man’s freedom
