There are appellate reasons to move for it even if it’s not getting granted.

It is a familiar rule of appellate practice that the legal sufficiency of the evidence to establish a claim or defense is a question of law which must be preserved for appellate review by a motion for judgment as a matter of law under CPLR 4401 (a motion for a “directed verdict” in common parlance) before submission of the case to the jury.

A party’s failure to move pursuant to CPLR 4401 for judgment as a matter of law at the close of the evidence is generally deemed an implicit concession that the evidence presented a question of fact for the jury. See Miller v. Miller, 68 N.Y.2d 871, 872 (1986).

Thus, raising the issue of insufficiency of the opponent’s proof for the first time after trial, by way of a post-verdict motion for judgment under CPLR 4404, will not operate to preserve this issue for appellate review.

On 22 December 1797 Phoebe captured the French 36-gun Néréide, Captain Antoine Canon.[11] Phoebe sighted the Néréide at 10am; the pursuit started at 11:30am and ended at 10:45pm with Néréide's surrender. During the chase Néréide fired her stern guns at Phoebe and the two vessels exchanged broadsides shortly before the Néréide surrendered. Phoebe lost three men killed and 10 wounded; Néréide lost 20 men killed and 55 wounded. Part of the reason for the disparity in casualties was that the ratio of the weight of the broadsides was 407 pounds (185 kg) to 268 pounds (122 kg).[12] In 1847, the Admiralty awarded the Naval General Service Medal with clasp "Phoebe 21 Decr. 1797" to all remaining members of her crew who had participated in the action.

Very stupid and reminds me of a great story from Massachusetts labor history: in the 50s, the meat packers union won the longest strike in state history in part because it was so racially integrated that it managed to organize the Black scabs the company brought in from the south.
