Does Westwood engage in good faith or is he blinded by his political beliefs? If the former, someone should tell him this is “up is down, grass is blue” levels of wrong regarding the history, intent, practice, and theory of the 501c3 designation. It is almost an exact 1:1 opposite of true!

Yeah I should clarify, he uses the example of hate crime enhancements to support his positive normative view of punishment: that punishment establishes civic equity. I don't read it as a statement about enhancements but using it 2 show how 1 can support punishment without reducing it to retribution.

Oh man, this politically motivated bias in sociology is so bad, look at this contrast. I wonder what happened to these guys' careers! Oh, huh, you're telling me Regnerus was subsequently promoted to full professor and Stewart got a bunch of articles retracted and fired from his job?

Sociologists are eager to punish those who deviate from the narrative. In 2012, Mark Regnerus, a professor of sociology at the University of Texas, published a study showing that children raised by same-sex parents tended to fare worse on social and economic outcomes compared to those raised by heterosexual families. His findings contradicted the sociological consensus that children raised by same-sex parents experience no disadvantages, sparking intense backlash. Critics attacked the study’s methodology, peer-review process, and even suggested that conservative organizations funded it.

Despite an inquiry that cleared Regnerus of scientific misconduct, sociologists remained hostile to his findings, viewing them as a challenge to the “sacred project” of social justice. By contrast, when the sociologist Eric Stewart engaged in large-scale data fabrication to support the narrative of systemic racism, journal editors and research gatekeepers suppressed the information, despite compelling evidence of misconduct.

Objectives. To examine racial/ethnic disparities in victim compensation claim approval rates for adult survivors of sexual assault.

Methods. We analyzed administrative data from 18 US state victim compensation programs (2015–2023), covering 45 934 claims from adult sexual assault survivors. We used multivariable linear probability models to examine predictors of claim approval, adjusting for survivor age and state and year fixed effects.

Results. Of all claims, 93.4% were from women; 41.7% were from White, 20.8% were from Latina, and 15% were from Black applicants. Black and Indigenous women’s claims were less likely to be approved than were White women’s (P < .001). The most common denial reason was lack of evidence that a crime had occurred (34.4%). Racial/ethnic disparities appear to be driven by administrative paperwork burdens. Approval rates varied widely, from 29.4% in Illinois to 94.1% in New Hampshire. Claims referred by hospitals or law enforcement had higher probabilities of approval than did those referred by other sources.

Conclusions. Racial disparities exist in victim compensation claim approvals.

This study investigates racial disparities in victim compensation among families of homicide victims across 18 U.S. states from 2015 to 2023. Using individual-level administrative data and national expenditure records, we find that families of Black homicide victims file more claims than any other group but have lower approval rates than families of White victims. We document statistically significant racial disparities in claim approvals, even after controlling for gender, state, and application year. The disparity is especially pronounced in denials attributed to “contributory misconduct,” a discretionary determination made largely by law enforcement assessing whether the deceased was engaged in conduct, broadly defined, that may have contributed to their victimization. Contributory misconduct accounted for nearly one-third of all denials, and families of Black victims comprised 57% of such denials despite accounting for only 46% of claims. Our findings show that this mechanism, alongside others such as incomplete applications and statutory ineligibility, disproportionately impacts Black families. These patterns suggest that discretionary and potentially racially biased judgments embedded in the compensation process can exacerbate structural inequalities in access to victim services. Our findings support recent but withdrawn proposals to revise the federal Victims of Crime Act Compensation Guidelines.

Abstract

Front-line workers mediate law on the books and law in action, translating higher-level laws into local policy. One important mediating institution is the police. Whereas most research analyzes how the law empowers police to label certain denizens “criminals” – both within and outside criminal legal contexts – this article demonstrates how policing also affects who is recognized as an innocent crime victim. Synthesizing existing scholarship, I theorize three paths through which police can affect legal recognition of crime victims: criminalization, minimization, and legal estrangement. I then test the extent to which these processes affect victims’ access to public benefits provided under victim compensation law. Drawing on never-before-analyzed administrative data from 18 U.S. states (N = 768,382), I find police account for more than half of all victim benefits denials. These denials are racialized and gendered: Police are significantly more likely to criminalize and be estranged from Black male victims and significantly more likely to minimize the injuries of Black female victims. Additional qualitative data suggest police systematically perceive Black men as not truly innocent and Black survivors of gender-based violence as not truly victims. These findings advance our understanding of the expansive role of police in society as well as the porous boundary between social provision and social control.
