Senator Warren had previously endorsed State Senator Mallory McMorrow. Title I of the Labor Management Reporting and Disclosure Act, 28 U.S.C.§ 411 (a)(2) guarantees that union members, even those serving as elected officers, enjoy a right to free speech for which they must not face retaliation. That right is fundamental to the union's democratic process. As the U.S. Supreme Court has emphasized, when elected officers are limited in expressing their views, the members who elect them are limited as well. Sheet Metal Workers v. Lynn,

Shawn Fain's statement is as follows:
Three and a half years ago, I was elected President of the UAW. Members elected me to change how we operate and put the membership first. Over those three and half years, we've rocked a lot of boats. We have taken on corporate America in order to win strong contracts. We have taken on the political establishment. And we challenged the status quo.
We haven't shied away from hard issues when the membership demanded it. As has been documented in the press and in the minutes of the UAW International Executive Board, on November 30, 2023, the IEB voted to call for a ceasefire in Gaza. In the subsequent months, Monitor Neil Barofsky made efforts to interfere in the political affairs of our union, culminating in a heated and highly personal disagreement, including inappropriate statements by Mr. Barofsky, at an EB meeting in February of 2024.
Soon after, he opened his first investigation into me. Mr. Barofsky has proceeded to issue report after report attacking our union, the rights of the President under the UAW Constitution, and the sincerity of my belief that Vice President Boyer and Secretary-Treasurer Mock were failing our members.

The current Oakland County Prosecutor who lost to the Jewish Washtenaw Co Prosecutor in the Democratic nomination for MI Attorney General is tying her loss to antisemitism.
