Public meeting scheduled Aug. 12 on draft permit for central KY power plant expansion

The Kentucky Energy and Environment Cabinet will hold a public hearing on a draft air construction permit for an expansion of the E.W. Brown Generating Station in Mercer County. The permit would authorize an additional gas-fired turbine at the facility that could increase its generating capacity by 681 megawatts, raising the facility's greenhouse gas emissions by over 2.3 million tons per year. It would also increase health-harming criteria air pollutants by nearly 500 tons per year. The cabinet will hold a virtual public hearing on the draft permit at 2 p.m. Eastern on Aug. 12 and is accepting comments on the draft permit until Aug. 6.

The Arizona Department of Environmental Quality will hold a public hearing on a draft air construction permit for the Mohave Energy Park in Mohave County. This new gas-fired power plant would be able to generate up to 195 megawatts of electricity. If constructed, it could emit nearly 1 million tons of greenhouse gases and over 400 tons of health-harming criteria air pollutants each year. The agency will hold a public meeting on the draft permit at 6 p.m. Aug. 6 at the Mohave Valley Fire Department, 1451 Willow Dri., Mohave Valley, AZ 86440. The agency is accepting comments on the draft permit until Aug. 7.

Blue Energy has proposed building a 1,100-megawatt gas power plant southeast of Victoria to provide electricity for nearby data centers. The company on June 23 applied for local property tax breaks, including from Bloomington Independent School District, under a state program. Electricity at the site would power a 1,600-acre artificial intelligence complex planned by Colorado-based data center developer Crusoe at the Port of Victoria in Calhoun County.

The U.S. Army Corps of Engineers is accepting comments until July 26 on Shell's application for a wetlands permit to build the Rome Pipeline off the coast of southeastern Louisiana, starting in LaFourche Parish. The pipeline would run 97 miles offshore, connecting Shell's Fourchon Terminal to offshore oil production hubs in the Gulf. If this application is approved, the resulting permit would authorize impacts to 26 acres of water bottoms to build the Rome Pipeline.

On June 30, the Second Circuit Court of Appeals unanimously rejected challenges to a New York City law banning the use of natural gas and heating oil in new homes and buildings. The judges also blocked a challenge to a state law requiring officials to adopt rules prohibiting appliances that burn such fuels. In California, the Ninth Circuit Court of Appeals on July 2 ruled 2-1 to uphold regulations adopted in 2024 by the South Coast Air Quality Management District adopted to require buildings to transition to zero-emission water heaters.

On July 1, the EPA proposed a rule eliminating federal requirements for public participation for so-called “minor” sources under the Clean Air Act. This would allow state and local air quality regulators to decide whether to notify the public or allow feedback on air permits for many types of facilities, including diesel generators for data centers. A public hearing is scheduled for 10 a.m. – 4 p.m. Eastern on July 22, with the last day to pre-register on July 19. Comments on the proposed rule are due Aug. 21.

The Texas Commission on Environmental Quality is accepting comments on an application by Intersect Power, a subsidiary of Google's parent company Alphabet, for an air construction permit to build the Roman Energy Center in Deaf Smith County. This new gas-fired power plant would be able to generate up to 1,474 megawatts of electricity, which would be used exclusively to power co-located data centers. If built, this facility could emit over 8 million tons of greenhouse gases and over 3,600 of tons of health-harming criteria air pollutants each year.

The Indiana Department of Environmental Management is accepting comments until Aug. 10 on a draft air construction permit for Life Cycle Power's Lebanon Facility in Boone County. This new gas-fired power plant would be able to generate up to 134 megawatts of electricity which would be provided exclusively to a co-located data center. If constructed, this facility could emit over 272,000 pounds of health-damaging hazardous air pollutants each year. Plans for two major gas pipelines projects across Alabama, Georgia, and Mississippi would involve crossing a combined 2,211 rivers, streams, lakes, and other water bodies, according to a recent report. On June 26, the Federal Energy Regulatory Commission issued a final environmental impact statement for the two separate pipeline projects. One is the Mississippi Crossing Project, a new 208-mile natural gas pipeline project across Mississippi. The report also covered South System Expansion 4, which involves building 291 miles of gas pipeline mostly parallel to existing pipelines across Georgia, Alabama, and Mississippi.

This project would entail constructing a 41-mile pipeline traveling from Lincoln County to Pulaski County in central Kentucky. This project, alongside the proposed Maysville Project, would support the expansion of East Kentucky Power Cooperative’s Cooper Power Station in Burnside and could transport up to 260 million cubic feet of natural gas per day.

Air Products on Tuesday announced it would cancel its $4.5 billion Louisiana Clean Energy Complex, which faced opposition from environmental groups and communities near the proposed injection site. The Pennsylvania company had in 2021 first proposed building a new industrial plant in Ascension Parish that would make hydrogen from natural gas, according to New Orleans Times-Picayune. Its plans involved piping carbon dioxide to Lake Maurepas, a brackish estuary west of New Orleans used for hunting, fishing, and boating.

The West Virginia Department of Environmental Protection is accepting comments until July 27 on a draft air construction permit for Clean-Seas' Belle Chemical Recycling Facility in Kanawha County. The facility would process used plastics via pyrolysis, melting and vaporizing plastics in the absence of oxygen, which would produce oil, gas, and a solid residue. The facility would be able to produce approximately 4 million gallons of pyrolysis oil annually, which could be used to produce new plastics, fuels, or industrial chemicals. The agency will hold a public meeting on the draft permit at 6 p.m. on July 14 at the Belle Town Hall’s Gym, 1100 E Dupont Ave., Belle, WV 25015.

The Trump Administration this week proposed reducing by over 90 percent the bonds oil and gas companies put up to cover cleanup costs when drilling on federal land. In 2024, the Bureau of Land Management raised the minimum bond that companies must put up for each oil and gas lease on federal land from $10,000 to $150,000. The BLM also proposed lowering the statewide bond, which covers all a company’s wells in a state, from $500,000 to $25,000. The move could allow oil and gas companies to pass on as much as $753 billion in plugging costs nationwide onto taxpayers, according to a report by Conservatives for Responsible Stewardship.

The Iowa Department of Natural Resources will hold a virtual public meeting on draft air construction permits proposed for the Bobcat Energy Center project at the Marshalltown Generating Station in Marshall County. This project would entail building three additional gas-fired turbines at the Marshalltown Generating Station that could increase its generating capacity by 750 megawatts. If built, this project could increase the facility's greenhouse gas emissions by over 1.5 million tons per year and emissions of health-harming criteria air pollutants by nearly 1,700 tons per year. The agency will hold a virtual public meeting on the draft permit via Zoom from 12-2 p.m. CST on July 24, 2026, and is accepting comments on the draft permit until July 24, 2026.

After a deadlocked vote last week on a proposal in Erie, Colorado, to sell the town’s mineral rights for drilling, council members narrowly approved the deal last week. Following more than two hours of public comment, council members voted 4-3 to allow Erie, about a half hour east of Boulder, to sell about 182 acres of its underground mineral rights to SM Energy. The company is proposing to drill horizontal wells underneath homes in Erie, according to KUNC News.

The U.S. Army Corps of Engineers is accepting comments until July 2 on an application by Venture Global for a wetlands permit to build the Phase III expansion project at its Plaquemines LNG Terminal in Plaquemines Parish. The expansion project would entail installing five additional pretreatment facilities, 16 additional liquefaction blocks, a 1.4 gigawatt on-site power plant, and other equipment. If this application is approved, the resulting permit would authorize impacts to 470 acres of wetlands. The Corps is allowing a shortened public comment period on this application, citing President Donald Trump's National Energy Emergency executive order.

On June 16, the Texas Commission on Environmental Quality (TCEQ) announced that Beacon Data Centers has applied for an air construction permit to build the Dove Creek Technology Campus Power Plant in Tom Green County. This new gas-fired power plant would be able to generate up to 2,409 megawatts of electricity, which would be supplied exclusively to a co-located data center. If constructed, the power plant and data center could emit over 9.7 million tons of greenhouse gases and over 2,800 tons of health-harming criteria air pollutants per year.

On June 15, the U.S. Army Corps of Engineers Caribbean District that announced New Fortress Energy applied for a permit to dredge the San Juan Harbor in Puerto Rico to create a docking space that would be continuously occupied by a liquefied natural gas (LNG) carrier functioning as a floating LNG storage facility. The Corps allowed a shortened public comment period that ends June 29 after New Fortress Energy applied for the permit invoking President Donald Trump’s executive order invoking a national energy “emergency.”

Circuit Court, American Fuel & Petrochemical Manufacturers challenged the administration’s renewable fuel standard for 2026 and 2027, according to trade publication Oils & Fats International. The standard set in March requires refiners and fuel importers to blend in record-high amounts of plant-based diesel fuel, while maintaining an existing mandate to blend 15 billion gallons per year of ethanol into motor gasoline.
