Abortion bans have always been about criminalizing the pregnant person.

The News & Observer reports that the young woman has been charged with “assault inflicting serious bodily injury on an unborn child, assault with a deadly weapon with intent to kill and negligent child abuse inflicting serious bodily injury.”

These are serious felonies with years, even decades, of possible prison time accompanying them. This young woman, who only just turned 18 in June, is facing long-term incarceration for allegedly purchasing and using medication abortion — mifepristone and misoprostol, two medications approved by the Food and Drug Administration — to terminate her own pregnancy.
But it’s not clear what the crime actually is.
“Fundamentally, self-managing an abortion is not a crime,” Dana Sussman, senior vice president at Pregnancy Justice, told Truthout. “North Carolina has rejected fetal personhood, which means that you cannot convert laws around children or other people to apply to embryos and fetuses … there is no basis in North Carolina law for these charges.”

In the first two years after Roe was overturned, Pregnancy Justice counted 412 pregnant people who have been charged with pregnancy-related crimes, despite abortion opponents’ insistence that they never intended, nor wanted, to see abortion patients prosecuted. The criminalization of pregnancy often relies on reinterpreting existing criminal statutes, including child abuse or drug endangerment, to penalize pregnant people for their pregnancy outcomes, even though these laws were originally written for entirely different purposes. In the case of the North Carolina teenager, “There is very clear language in the statutes that talks about harm to an ‘unborn child’; that is very specific about harm by an external actor to someone who is pregnant. That is not about a pregnant woman or pregnant person doing anything to their own body,” Sussman said.
This is how pregnant people end up dead — not from taking medication abortion or going to an abortion clinic, but from being too scared to access care when they need it.

Black August remembers key figures in the Black liberation movement. It’s a time of reflection and deep study of Black political thought from freedom fighters. Here are some books to add to your reading lists!

Not long after a woman from Jackson, Wisconsin, learned she was 12-weeks pregnant, five police officers knocked on her door with a warrant for her arrest. They jailed the 28-year-old for days, moving her from courtrooms to clinics in handcuffs and shackles.

Her crime? She declined to continue a prescription that had run its course. She’d recently finished taking suboxone, a medication-assisted treatment for an overreliance on painkillers. She never tested positive for controlled substances.

A year later, in 2014, a woman went to Taylor County Department of Human Services for a pregnancy test. A urine test confirmed the pregnancy, but she also tested positive for controlled substances. She told doctors she had decreased her use and needed help.

Two months later, she was incarcerated for not agreeing to a tuberculosis test or admitting herself into an inpatient facility. For 18 days, she was provided no prenatal care.

After requesting an obstetrician for cramping and being uncooperative when she was seen by a jail doctor who lacked the OB-GYN expertise she required, jail personnel put her in solitary confinement.

Both women struggled to find legal representation. Their fetuses, however, both had guardians assigned to them per Wisconsin statute. Since 1998, Wisconsin has had an unconstitutional law on the books: Act 292, the Unborn Child Protection Act. It’s known colloquially by its cruder name, the "Cocaine Mom Law."

“What that actually means in practice is that any pregnant woman is a walking potential crime scene,” said Dana Sussman, senior vice president of Pregnancy Justice, a national nonprofit advancing the rights of pregnant people. “If you don't act the way (the state) wants, you could be suspected of a crime.”

And as a recent article by the Milwaukee Journal Sentinel found, Child Protective Services agencies across Wisconsin investigated 1,465 allegations of unborn child abuse under the law between 2020 and 2024, which placed 146 children in out-of-home care within 60 days of the allegation...

Sussman and her team have pushed for repealing Act 292 for years.

Wisconsin is one of five states that authorizes civil commitments of pregnant individuals on the basis of alleged substance use disorder.

Alabama has one of the strictest conditions in the nation for medical marijuana, requiring monthly pregnancy tests in a doctor’s office for certain patients.

For women between the ages of 11-50, the state requires pregnancy tests every 30 days to keep their registration current, unless they can show proof they’ve had surgery that prevents having children.

“I am not aware of any other state that has a framework like this,” said Dana Sussman, senior vice president of national legal and advocacy nonprofit Pregnancy Justice. “This, I think, is the first sort of mechanism of regular surveillance, regular proving that you’re not pregnant in order to access something that is available to, or should be available to everyone.”

Here, physicians are prohibited from certifying or recommending medical cannabis to any patient who is pregnant, breastfeeding or “attempting to conceive,” according to the Alabama Board of Medical Examiners’ code.

In Alabama, a positive drug test can have dire consequences for pregnant women and new mothers. They can lose custody of their newborns and other children, and face lengthy prison sentences and thousands of dollars in fines.

Since Alabama passed its chemical endangerment law in 2006, prosecutors have filed charges against hundreds of women based on allegations of drug use, including recreational marijuana, during pregnancy. The state leads the nation in jailing pregnant women for drug use.

Alabama is also one of only three states, along with Oklahoma and South Carolina, where the state Supreme Court allows criminal laws meant to punish child abuse or child endangerment to be applied to pregnancy.

“The surveillance apparatus of this is deeply concerning,” she said, calling it discriminatory for women and people with disabilities. “For half the population to prove a non-pregnancy regularly is deeply problematic, and to have to then also give people fewer options to manage their pregnancies is also deeply problematic.”

Since last year, New Mexico’s unconstitutional directive has been separating mothers from newborns. We filed a brief before the New Mexico Supreme Court in support of @aclunm.bsky.social's legal case to challenge this harmful measure. A drug test isn’t a parenting test.

New Mexico is requiring its family policing agency to file abuse and neglect cases for every newborn exposed to substances – and to immediately separate newborns from their families. This violates New Mexico’s own state laws and constitutional protections and federal laws requiring efforts to keep families together. No pregnant woman should have to endure the sick and horrifying treatment that Ms. McElroy did. The law requires humane treatment and access to necessary care, yet those basic protections were denied. Our lawsuit seeks accountability for this inexcusable inaction. We are proud to stand with her.

A woman was left to labor alone by staff in an Alabama jail for over 24 hours. She and her baby were only saved by other courageous detained women, who helped her deliver on the floor.

Pregnancy Justice, the Southern Poverty Law Center, and Sullivan & Cromwell LLP filed a federal civil rights lawsuit on behalf of her and her infant daughter.

Tiffany McElroy was days into her detention at the Houston County Jail when her water broke. She cried out for help, and other jailed women banged on walls and tables, begging jail staff to take Tiffany to a hospital.

The women were met with threats of lockdown, being written up, or being tased. Ms. McElroy was left slipping in and out of consciousness.

The other women stepped in and provided what the jail did not: humanity and actual care.

When her baby was finally born, limp and blue, they sucked mucus from the baby’s mouth and nose with their own mouths, and they rubbed and patted the newborn until she finally cried.

Tiffany and her baby’s constitutional rights were violated. The jail, county, and others completely disregarded the health and safety of mother and child.

They unnecessarily forced Tiffany to endure a dangerous, painful, and terrifying birth experience – and they must be held accountable.

Ms. McElroy’s treatment was not an isolated incident. The Houston County Jail has a long history of providing inadequate medical care to pregnant and postpartum people.

And Alabama continues to lead the nation in jailing women for “endangering” their pregnancies while doing nothing to provide care for pregnant people.

The Terrifying Convergence of Fetal Personhood Laws and Abortion Bans

A Georgia woman was charged with murder for an alleged abortion. “Fetal personhood” laws may be as much to blame as the state’s abortion ban.

Commonly referred to as the Georgia six-week-abortion ban or “heartbeat” ban, the state’s Living Infants Fairness and Equality Act goes much further. The LIFE Act stipulates that an “unborn child” becomes a legal person within weeks of conception, and then elaborates that “no abortion is authorized or shall be performed” on an “unborn child,” so defined. “The ban is a fetal personhood ban,” said Karen Thomspon, legal director at Pregnancy Justice, an organization defending the rights of pregnant people against pregnancy criminalization. To grant a fetus legal rights, she said, is to say that “the state has more interest in the fetus than in the pregnant person.” The case against Moore does concern the state’s abortion ban, but it’s this element of the law—the idea that an embryo or fetus is a legal person, a fiction invented to ban abortion—that police may have had in mind as justification for their charges against her.

“You don’t have to make abortion illegal,” Thompson emphasized. “You just make it so untenable, or so dangerous, or so carceral,” that it becomes an impossible risk to take.

It is likely that with both the push for fetal personhood and against medication abortion, we will see more cases like this recent one in Georgia. This isn’t so much a consequence of Dobbs or of any particular abortion ban, but of multiple anti-abortion strategies long in play now converging, fueling police and prosecutors’ confidence in making these types of arrests and bringing these types of cases. There’s a “casualness” to exposing a pregnant person’s life, as Moore’s has been, Thompson said, “blasting their faces in mugshots all across the world, for things that are really at their core poor lawyering and misogyny.” At bottom, the state has an interest in controlling women, punishing them for being pregnant the wrong way, or punishing the wrong women for being pregnant. “We are going to continue to fight to make sure that people are getting the care they need,” Thompson said. “That care is just not in the courts.”
