Compare with the Trident of Fish Command that Rob mentions in the thread. It's worse than an Enspelled weapon that casts dominate beast! Fewer charges, and only works on swimmers. It's uncommon instead of rare, so maybe it's cheaper... but buying loot isn't as fun as finding loot. Because of story.
Here's my “yes, and” for this great thread on magic items. The enspelled weapon is a good framework for DMs to understand how to design balanced magic items. But it cares more about game rules than story. It takes the magic out of magic: this item feels mass-produced in a factory.
