While the litigation decision in the case over West Virginia’s trans sports ban not to challenge the definition of “sex” in Title IX as meaning anything beyond “biological sex” meant that the three Democratic appointees agreed with the Republican appointees that Becky Pepper-Jackson’s Title IX challenge to West Virginia’s law failed, Jackson was not done. She authored a three-page solo opinion to add an additional, important discussion into the mix.

After describing that conclusion regarding the Title IX challenge in the B.P.J. case, she wrote, “But there is reason to doubt the soundness of the concession that Title IX’s reference to ‘sex’ means only sex assigned at birth.“

It was an essential comment, and the three paragraphs that followed spoke ambitiously about what the United States could be if its laws were, as she wrote, “properly construed.”

I've been thinking a lot about this snippet of Foucault that Judith Butler cited in 'Gender Trouble'. 'Sex' is often held in these legal opinions to be a 'self-evident' and 'immutable' category, eliding how it is an agglomeration of variable and varied traits given meaning for regulatory reasons.

“ … the notion of 'sex' made it possible to group together, in an artificial unity, anatomical elements, biological functions, conducts, sensations, and pleasures, and it enabled one to make use of this fictitious unity as a causal principle, an omnipresent meaning: sex was thus able to function as a unique signifier and as a universal signified.”

June: I just think we have to think of the possibility: Would it have been better if there had not been visibility? And I don’t think it would have. I also think that we shouldn’t act like our opponents, the people who are cynically exploiting other humans for their own ends, whatever they are, are acting in good faith. So for us to take a sort of reasonable view of what has helped and what has hurt, no. I don't even know where to fucking begin with this. It's the same fight, same propagandists, same talking points recycled into anti-trans ones and now revised for a renewed push against so-called "LGB" rights. They didn't accept gay marriage, they fucking regrouped and picked a new attack vector.

On the other hand, I completely agree with you, Bryan, that visibility—for trans people who just wanted to live their lives, not necessarily stealth or anything, but literally just live without being a political movement and a hyper-politicized identity and an issue—visibility has been terrible. And I’ve been thinking a lot about why it was so different for LGB people, because that was Harvey Milk’s big strategy, to come out, and it worked. That was why the gay rights movement wasn’t quashed in its early stages, because people came out and everyone realized, like, Oh, queer people are all around us and they’re, like, pretty OK, or at least as OK as cishet people.

But I think trans identity really threatens the underpinnings of gender and gender hierarchy in a way that gay identity only kind of brushes up against. And you can see that in the issues that the right has pinpointed, like gender-segregated spaces, sports, and bathrooms, and for a political movement that is really invested in a gender hierarchy and gender norms, transness is super threatening. They can make the argument that “This really threatens our way of life” in a way that gay marriage or whatever doesn’t, where you just have to kind of don’t pay attention to that if you don’t want to.

To pretend that violence is an inevitable consequence of queer visibility, that the backlash and abandonment by cis people just couldn't be helped or avoided, is to blame trans people for the pursuit of dignified and legible lives outside the margins. Fuck off with this.

June Thomas: I’m very torn about this because I do think that especially around trans issues, there is this kind of division between people being exploited, because, well, trans people are people, and yet when the Republican Party uses them, they’re not thinking about human beings, it’s just an issue that they’re exploiting. And at the same time, I have heard for many years from trans activists that trans activism is best when it kind of happens under the radar. That people are talking to companies, they’re talking to politicians, they’re talking and they’re not doing it with a big ta-da. They’re doing it not in secret either, but quietly, because attention doesn’t necessarily bring better results.

After the Cass Review was published in April of 2024, a ban on gender-affirming care was made permanent by the Labour government. Now, a planned study into the effects of puberty blockers is itself under siege by anti-trans activists. The activists maintain, without evidence, that the drugs (which are entirely reversible and regularly used to treat early puberty in cis children), are too dangerous even for a study to examine their efficacy in helping young people with gender dysphoria.

In response, Dr. Cass has once again strayed into a few moments of honesty about what the research actually says about puberty blockers. Cass reportedly told the BBC that “some of the hype about risks have been exaggerated in that we genuinely don’t know if there are harms.”
