extent WPATH-TX has any legal gripe with this enforcement action, it is free to raise it before this forum. And should it disagree with this Court's resolution of those gripes, the proper course is an appeal to the Fifth Circuit or the Supreme Court. What it cannot do is what it has tried to do here: ask a district judge across the country to superintend this Court's proceedings.

WPATH-TX has made no secret about why it is attempting this gambit and it is not because it thinks its far-fetched (and in fact, oft-rejected) legal theories have any merit. It is because it does not trust the Northern District of Texas to handle this matter fairly. In its D.D.C. filing, WPATH-TX made the extraordinary claim that this District is an outlier on these issues and mischaracterized it as essentially a rubber-stamp for the government, unbounded by law. This Court should not countenance an effort premised on that offensive and baseless theory. There is no doubt that district judges in the Northern District of Texas will apply the law as fairly and impartially as district judges anywhere else.

Accordingly, this Court should protect its own jurisdiction and enjoin WPATH-TX's attempt to "circumvent the authority of this Court and the Fifth Circuit" through collateral proceedings. In re Admin. Subpoena 25-1431-032, No. 4:26-mc-0006 (N.D. Tex. May 18, 2026), ECF No. 26 at 6. This Court should grant the Federal Trade Commission, Texas, and Iowa's ("Movants") Motion as swiftly as practicable. Given this highly irregular and improper course of action by WPATH-TX, this Court should take steps to protect its jurisdiction by enjoining the Defendants in this case from seeking relief regarding this proceeding in any court other than this Court, the Fifth Circuit or the Supreme Court. Packard is not the only hospital outside Texas that DOJ has targeted from that state. In April, DOJ sought (and received) an order from the Northern District of Texas compelling Rhode Island Hospital to disclose the patient records of transgender minors in response to an administrative subpoena.31 And on the same day DOJ issued the grand jury subpoena at issue in this case, it issued a nearly identical subpoena to NYU Langone Hospitals in New York.32 Nothing on the face of the grand jury subpoena served on Packard suggests any nexus to Texas—for example, the requested records are not limited to care provided to patients from Texas. But as the Texas judge presiding over certain matters relating to DOJ’s subpoenas has explained, DOJ is “a frequent forum shopper.”33 In the related matters involving subpoenas issued to Rhode Island Hospital and NYU Langone, courts have found that DOJ is engaged “in an obvious effort to shield its recent investigative tactics—previously rejected by every other court to review them—from [those courts’] review, in favor of a distant forum that DOJ deems friendly to its political positions.” In re Admin. When Levin asked what she thought about the rights of trans people, Gaines said, “So long as my taxpayer dollars aren't being used and it’s between consenting adults, I really don'’ care.” What does being trans have to do with consenting adults? Gaines seems to, as per usual on the right, confuse gender with sexuality and painting trans identity as some kind of sexual fetish, rather than, well, an identity.
