Hm, this doesn't seem weird at all. The FBI merch claims are "absolutely, 100% false" but the firing of Iran counter-terroris, agents is only "not true." I guess that one is false, but less false than the first one?

From the complaint:
Prior to publication, the FBI expressly informed Defendants that each of these claims was false, including that the merchandise claim was “absolutely, 100% false” and the Iran-squad claim “is not true.”

Seriously, @nytimes.com, do you even journalism anymore? You ask the 10 am barflies (hoping for a free drink from the TV) what they think - whatever. But then you say the same conversation is happening "across rural Minnesota." What is the basis for this sweeping statement?

@bcdreyer.social, could you please begin a campaign against people who don't know the difference between "vice" and "vise"? Particularly journalists and their editors? (And maybe judges?) Nobody claims Chicago is in a "vice hold of violence."

From a Chicago Sun-Times article reporting on Judge Ellis's ruling in the Bovino use-of-force case:

"The [Trump administration] would have people believe, instead, that the Chicagoland area is in a vice hold of violence, ransacked by rioters and attacked by agitators," she added. "That simply is untrue. And the government's own evidence in this case belies that assertion."

Doesn't parody have to be somehow commenting on the parodized property? From Dr. Seuss v. Penguin Books: "Courts have allowed parody claims only where there was a discernable direct comment on the original." (I don't know if this is still good law, or if it's been changed by later cases.)

In sum, satire and parody are generally egregious forms of infringement, taking the best elements of the most expressive works. The choice to take protected elements from a copyrighted work is reasonable and fair only when it is necessary. It is necessary only when one of the targets of the satirist is the work itself, because only then is it fair to presume that the satirist has no alternative to infringement, and only then is it fair to presume that the author would not profit from the granting of a license. The reasonableness extends only to that appropriation of the original that is required to fulfill the parodic purpose.

He may be the smartest person on the panel (low bar), but this shows that he doesn't really understand that Rufo, Yarvin, et al., don't give a shit about "majority support" or public approval of their program.

But challenged by Rufo, who explicitly endorses such a political test for public employment, he reverts back to the public relations argument - saying the problem with Rufo's position is that "it doesn't command majority support."
